Attached is a copy of the revised lot division/combir�ation
agreement, required as a condition of the Pine Bend
Development Co. lst Addition plat approval. As discussed
at the August 21, 1990 City Council Meeting, the area shown
on the plat as Outlot A is subject to ownership by D.W.
Severson, by right of adverse possession. The agreement
accommodates the creation of Outlot B and requires its
combination to the balance of property owned by Severson.
The agreement eliminates the existence af a non-corforming
parcel.

AGREEMENT
THIS AGREEMENT made and entered into this day of
August, 1990, by and between D.W. SEVERSON, a single person,
hereinafter "Severson" , PINE BEND DEVELOPMENT CO. , a Minnesota
partnership, hereinafter "Pine Bend" , and CITY tJF ROSEMOUNT, a
Minnesota municipal corporation, hereinafter "City" .
WITNESSETH: �
WHEicEAS, S2verson is owner ai the �ollowing. descrihed �
premises, to-wit:
PARCEL A: That part of the West 133 . 33 acres of the
Southeast Quarter (SE 1/4) lying North of
State Trunk Highway #55, Section 20, Township
115, Range 18, Dakota County, Minnesota.
WHEREAS, Pine Bend is owner of the following described
premises, to-wit:
PARCEL B: Outlot A, Pine .Bend Development Co. lst
Addition.
WHEREAS, City approved the Pine Bend Development Co. lst
Addition plat subject to execution of this Agreement.
WHEREAS, it is the intention of Pine Bend to convey title of
Parcel B to Severson. .
WHEREAS, the said Parcels A and B are adjacent to each other
and have a common boundary line.
NOW THEREFORE, in consideration of the above and other good
and valuable consideration, the parties hereto agree as follows:
1. Pine Bend shall convey Parcel B by Quit Claim Deed to
Severson. Pine Bend shall record said Quit Claim Deed and this
Areement in the Office of the Dakota County Recorder in
conjunction with filing the plat of Pine Bend Development Co. 1st

2 . Subsequent to the conveyance of Parcel B to Severson,
Parcels A and B shall be considered a single integral tract for
purposes of the City's zoning and subdivision ordinances and
shall not be sold, transferred, encumbered, or otherwise
alienated separately.
3 . This Agreement shall run with the land and be recorded
against title to Parcels A and B.
IN WITNESS WFiEREOF, the parties hereto have executed this
