Attached for your review are the "Amendment No. 1 to Material
Recovery Agreement" between the City of Rosemount and Knutsan
Services, Inc. and the "Amendment No. 1 to Construction Recovery
Facility Agreement" between the City of Rosemount and Donald &
Michael Hinz .
These amendments are consistent with recent revisions in the
Metropolitan Council ' s Capital Assistance Grant Program requirements,
regarding liens on equipment purchased with the grant proceeds.
Originally, the Metropolitan Council prohibited lending institutions
from placing liens on equipment purchased with the grant proceeds or
matching funds. The program revisions now permit lending
institutions to place liens on the matching funds. This will allow
both third parties to obtain additional financing for their projects,
without jeopardizing the position of the City of Rosemount or the
Metropolitan Council.
RECOMMENDED ACTION: To approve the "Amendment No. 1 Approved by•
to Material Recovery Facility Agreement" between the
City of Rosemount and Knutson Services, Inc. and the
"Amendment No. 1 to Construction Recovery Facility Agreement" between
the City of Rosemount and Donald & Michael Hinz.

AMENDMENT NO. 1 TO
MATERIAL REC�VERY FACILITY AGREEMENT
AGREEMENT made this day of August, 1990, by and between
the CITY OF ROSEMOUNT, a Minnesota municipal corporation ("City") ,
and KNUTSON SERVICES, INC. ("Knutson") .
1. Backqround. The parties have previously entered into a
contract concerning a material recovery facility dated
December 20, 1990 ("Agreement") . That Agreement shall remain in
full force and effect except as specifically amended by this
agreement.
2. Amendment. Paragraph 4 (C) of the Agreement is amended to
read:
No liens or encumbrances shall be allowed to attach to the
equipment purchased with proceeds, in the amount of $132,061,
obtained from the Metropolitan Landfill Abatement Fund Capital
Assistance Grant program. The following equipment is to be
purchased with said funds:
1) PLASTICS GRANULATOR

2) HORIZONTAL BALER/FEEDER &
PLASTICS PERFORATOR

AMENDMENT NO. 1 TO
CONSTRUCTION RECOVERY FACILITY AGREEMENT
AGREEMENT made this day of August, 1990, by and between
the CITY OF ROSEMOUNT, a Minnesota municipal corporation ("City") ,
and MATERIALS RECOVERY, LTD. ("MRL") .
1. Background. The parties have previously entered into a
contract concerning a construction recovery facility dated
May 21, 1990 ("Agreement") . That Agreement shall remain in full
force and effect except as specifically amended by this agreement.
2. Amendment. Paragraph 4 (C) of the Agreement is amended to
read:
No liens or encumbrances shall be allowed to attach to the
equipment purchased with proceeds, in the amount of
$150, 000, obtained from the Metropolitan Landfill Abatement
Fund Capital Assistance Grant program. The following
equipment is to be purchased with said funds:
1) 1600 ELECTRIC TRANSFER MACHINE

2) FRONT END LOADER

3) 1979 MACK MR WITH 1990 MULTI-LIFT ATTACHMENT
