', ' , , , CITY OF ROSEMOUNT EXECUTIVE SUMMARY FOR ACTION CITY COUNCIL MEETING DATE: SEPTEMBER 4, 1990 AGENDA ITEM: AGENDA SECTION: SHANNON HILLS PUD ADDENDUM NO. 1 OLD BUSINESS PREPARED BY: AGEN� � � � Michael Wozniak, City Planner Steve Fiterman, Developer of the Shannon Hills Planned Unit Development (PUD) has requested that the City Council consider an addendum to the Shannon Hills PUD Agreement dated August 29 , 1989 . Attached with this Executive Summary are copies of the original Shannon Hills Phasing Plan, a revised Phasing Plan and a PUD Agreement Addendum. In conjunction with a discussion regarding neighborhood concerns over management of Carroll ' s Woods City Park the City Council at its August 7th meeting indicated a preference that the park dedication to have received in phase II be deferred until platting of Shannon Hills 3rd Addition and that the PUD Agreement be modified accordingly. The Planning Commission at its August 28th meeting recommended that City Council approve the Shannon Hills Planned Unit Development and Master Subdivision Agreement Addendum. RECOMMENDED ACTION: Approved by• Motion to approve Addendum No. 1 . to the Shannon Hills Planned Unit Development and Master Subdivision Agreement. COUNCIL ACTION: Approved. �� �_ � ADDENDUM N0. 1 TO THE SHANNON HILLS PLANNED UNIT DEVELOPMENT AND MASTER SUBDIVISION AGREEMENT AGR�EMENT dated , 1990, between the CITY OF ROSEMOUNT, a Minnesota municipal corporation (the "City" ) , and GROUND DEVELOPMENT CORPORATION, a Minnesota corporation (the "Developer" ) . 1. Prior Agreement. This is an addendum to a Planned Unit Development and Master Subdivision Agreement between the parties for SHANNON HILLS dated August 29, 1989 . Except as specifically set forth below, the prior agreement between the parties remains in tull force and effect. 2. Revised Phasing Plan. The City has previously approved a preliminary plat and phasing plan shown on the Shannon Hills Final Development Plan, referenced as Plan A, in the Planned Unit DeveTopment and Master Subdivision Agreement between the parties for SHANNON HILLS dated August 29, 1989 . The City agrees to approve a "revised" phasing plan (dated August 15, 1990) , referenced herein as P1an B. Plan B shall serve to replace the original phasing plan included within Plan A. . 3. Park Dedication. Paragraph 6. , of the Planned Unit Development and Master Subdivision Agreement between the parties for SHANNON HILLS dated August 29, 1989, shall be amended to read as follows: "Based upon the maximum number of housing units permitted in the Final Development Plan, the total park dedication for the development is 7 . 60 acres . The Developer shall dedicate to the City by warranty deed 0 . 62 acres of park land as shown on the attached Plan B upon final plat approval of Shannon Hills 3rd Addition. To meet the additional dedication requirement of 6. 98 acres the Developer shall make a cash contribution to the City upon final plat approval of each phase of Shannon Hills Planned Unit Development based upon the 8/23/90 •Y. , F' formula established in Subd. 5 . 7 of the City of Rosemount Subdivision Ordinance (Ord. No. XVII .4) . The amount of cash contributions per acre shall conform to the rate established by the City for the year in which final plat approval for each phase takes place. Any amendments to the Final Development Plan, causing an increase or decrease in the number of housing units, will result in a corresponding increase or decrease in the amount of cash contributions to the City. ° IN WITNESS WHEREOF, this agreement has been executec by parties the day and year first above written.
