This item cc:�sists of explaining the need for and recommendation to
adopt the attached resolution to initiate eminent domain proceedings
in order to acquire ponding and drainage easements for Project #197
and also property for Jaycee Park.
The reason for proceeding with condemnation is that a third party
developer could potentially pose problems and delays withoae��mpleThe
negotiation with the property owners for the necessary p P Y•
developer had an option to purchase the 40 acre parcel just south of
Valley Oak Pond and the property the future addition to Jaycee Park.
Project #197 requires obtaining ponding and drainage easements within
this parcel and the addition to Jaycee Park requires obtaining 8 . 3
acres just south of the existing park. Staff understood that the
developer had defaulted on his option and we could deal strictly with
the landowner, who we have delt with successfully �hasrallenedly in
the past. However, there is some doubt regarding g
default. Therefore, staff is recommending to proceed with
condemnation proceedings in order to make sure we can acquire this
property in a timely fashion. Once our city attorney files the
appropriate papers, we will take possession of the necessary
easez�lents within 90 days. We can and will still proceed with
negotiatiUns with the property owner in case the default is valid.

A RESOLUTION AUTHORIZING CONDEMNATZON PROCEEDINGS FOR
VALLEY OAR POND OUTLET IMPROVEMENTS
CITY PROJEC'I' #197 & SOUTH 8.3 ACRES OF
JAYCEE PARR
WHEREAS, the City of Rosemount has determined that it is in the
public interest to acquire the property necessary for City
Improvement Project No. 197 and the south 8 . 3 acres of Jaycee Park.
NOW THEREFORE BE IT RESOLVED, by the Council of the City of
Rosemount, Minnesota:
The City Attorney is hereby authorized and directed to acquire
the property necessary for the City Improvement Project No.
197 and the south 8 . 3 acres of Jaycee Park by eminent domain
proceedings unless acquired by negotiation or otherwise before
the proceedings are complete.
ADOPTED by the Council this 4th day of September, 1990.
