PRELIMINARY PLAT
Recommended Motion: A motion to approve a Resolution Givinq
Approval to the Pine Bend Development Co. ist Additian Preliminary
Plat and Settinq out Conditions for Final Plat Approval.
Background
As part of the Parker Communications A.M. Radio Communications
Facility Project, Pine Bend Development Co. has submitted a
Preliminary Plat for Pine Bend Development Co. 1st Addition.
Enclosed with this review is a copy af the preliminary plat, a map
indicating the boundaries of the three existing metes and bounds
description parcels effected by this subdivision, and a copy of a
Resolution authorizing approval of the Preliminary Plat.
The Parker Communications site is 38 acres and includes portions
of three existing metes and bounds description parcels (see map) .
Two of the parcels include property on the south side of Highway
55. The proposed subdivision would create three lots: the 38. 6
acre Parker site Lot l, Bloek 2 ; a 7.2 acre parcel on the south
side of Highway 55 to be retained by Pine Bend Dev. Co. , Lot 1,
Block 1; and, 136.5 acres on the north side of Highway 55, to be
retained by Pine Bend Development Co. , Lot 2, Block 2 .
The property is currently zoned Agriculture and would remain in
that zoning designation. Other than the Parker project there is
no other development proposed for the project.
Lot size minimum for the agriculture district is 2. 5 acres however
there is a limit for residential density of 1 unit per ten acres.
To avoid having to place a restrictive covenant on property the
City normally requires a minimum 10 acre lot size. The Commissian
� should note that Lot l, Block 1 is 7.2 acres in size. Remnants of
two of the existing metes and bounds description parcels would be
combined to form this lot. Since Highway 55 physically separates
these remnants from the remainder of the respective parcels for
development purposes they are separated now even though legally
they remain attached to property north of Highway 55.
Because the Parker Site (38.6 acres) will not be developed for
residential use there is no danger of exceeding the one residential
unit per ten acre density requirement of the zoning ordinance for
the gross acreage of the subdivisian.
Normally upon subdivision of land the City would require park
dedication. However, the Pine Bend Development 1st Additian will
remain in agricultural zoning. The subdivision authorizes the City
to require payment of park dedication only for residential,
commercial or industrial subdivisions. It should be noted that it
will be required by the Parker Communications Interim Use Agreement
that 1/2 of the Parker Communications site (19 acres) be preserved
as a wildlife natural habitat area.
City Engineer, Rich Hefti, has reviewed the preliminary plat and
made the following recommendationss
1. The City should require that existing street easements for
Fahey Avenue and Pine Bend Avenue (33 feet wide) be
dedicated as Public Right-of-Way and be indicated as such
on the plat.
2 . The City should require that a 10 foot wide drainage and �
utility easement be indicated on the plat abutting all
Public Right-of Way.
3 . It has been found that a surveying error has been made in
preparation of the preliminary plat which would require the
west lot boundaries indicated on the preliminary plat to
be moved approximately twenty (20} feet to the east. It
is recommended that the City require that this correction
be made on the final plat.
The Planning Commission has found that the preliminary plat meets
all zoning and subdivisions ordinance requirements and has
recommended that the Council approve the Pine Bend Development Co.
1st Addition Preliminary Plat subject to the City Engineer's
recommendations.

THE PINE BEND DEVELOPMENT CO. 1ST ADDITION
' PRELIMINARY PLAT
AND SETTING OUT CONDTTIONS FOR FINAL PLAT APPROVAL
WSEREAS, the City of Rasemount has recieved a Preliminary Plat for
the East One Third of the East One Half of the Southeast Quarter
of Section 20, Township 115, Range 18, and, the Southwest Quarter
of Section 21, Township 115, Range 18, lying southerly of Pine Bend
Trail, known as Pine Bend Development Co. lst Addition; and
WHEREAS, the Planning Commission of the City of Rosemount has
reviewed said Preliminary Plat and submitted its recommendation to
the City Council; and
WHEREAS, the required public hearing and notificatians have been
completed.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of
Rosemount approves the Pine Bend Development Co. lst Addition
Preliminary Plat, subject to the following:
1) Existing street easements for Fahey Avenue and Pine Bend
Avenue (33 feet wide) shall be dedicated as Public Right-
of-Way and be indicated as such on the Final Plat; and
- 2) A 10 foot wide drainage and utility easement shall be
indicated on the Final Plat abutting all Public Right-
of Way.
3) A correction shall be made on the Final Plat to account
for a surveying error made in preparation of the
preliminary plat which would require the west lot
boundaries indicated on the preliminary plat to be moved
