This memo will verify the authenticity of the petition and recommend action for Council to take. We have reviewed the County tax records to find that Ground Development, Inc. is the soul owner of the property that will develop as the Shannon Hills 2nd Addition. Therefore, this petition does represent 1000 of the effected property owners. Although the 100o petition does not require by law the conducting of a public hearing, are Bond Council racommends holding such a hearing to be on the safe side. What this petition does allow the City to do is to allow our Consultant to prepare plans and specifications at the same time they are preparing the feasibility report. This allows us to have the plans and specifications prepared at the time of the public hearing in order to speed up the public process. Without the 100% petition, we would have to wait until after the public hearing in order for Council to approve the preparation of plans and specifications. Once we have received the feasibility report, we wi11 have the appropriate resolutions for Council to consider to order the preparations of plans and specifications. Then these will be done by the time the public hearing is held and Council can authorize going out for bids after the public hearing. Recommended action for Council to consider is to adopt the attached resolution, receiving the petition and ordering the preparation af the feasibility report for Shannon Hills 2nd Additian Street & Utiiity Improvements, City Project #216. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Rosemount as follows: (1) the aforesaid petition represents 100% of the owners of the affected property; (2) the property owners request in the petition that the improvements be constructed and that the entire cost for their share less the City's share of the cost of the improvement be assessed against the property; ;; (3) the aforesaid petition is approved and placed on file; and (4) the City Engineer is directed to have the necessary feasibility report prepared for Shannon Hills 2nd Addition Street & Utility Improvements, City Project #216. Receive PetitionjOrder Feasibility Report for Shannon Hills 2nd Addition The petition the developer submitted included 40 lots as per the sketch he attached. This memo is basically to inform Council that the developer, through the PUD Agreement, is to include the outlot for park dedictation with his second phase. Therefore, I will instruct our consultants to include extending utilities and streets up to that outlot. This would add 2 lots to the total the developer requested in the petition. If in the course of the public improvement hearing it appears to be not appropriate to extend utilities and streets up to the park outlot at this time, then we can cut back to the original 40 lots then.
