ADOPT RESOLUTION APPROVING AGRICIILTURE PRESERVE RENEAAL Three Rosemount property owners have applied to enroll or re- enroll properties they own into the Metropolitan Agriculture Preserves Program. As City Council is aware this program provides a tax break to owners of Agricultural property provided the property is kept in Agricultural use for a minimum of eight years. The program also restricts residential development density for land in the program to one home per forty acres. Enclosed with this review is a copy of a resolution to authorize enrollment or re-enrollment of several :parcels of land into the Agricultural Preserves Program. Attached with the resolution is a map indicating those properties being enrolled and also a list of legal descriptions of the properties in question. The properties to be enrolled or re-enrolled in the Agricultural Preserves- Program are owned by Mr. Hans Abrahamsen, Mr. Earl Bester, and Mr. and Mrs. Earl Knodt. Mr. Bester and the Knodt's 'are re-enrolling properties which were originally enrolled in the program in 1982. Mr. Hans Abrahamsen is re-enrolling 5 parcels of property and is enrolling for the first time 2 new parcels which he has recently purchased. I have determined that all properties being considered for enrollment or re-enrollment are currently being utilized for Agriculture. All of the properties in question are designated Agriculture in the City of Rosemount Comprehensive Guide Plan and are zoned Agriculture Preserve or Agriculture. In a separate action at this meeting (see item 6) the Council will consider rezoning from the Agriculture District to the Agriculture Preserve District the two parcels of property owned by Hans Abrahamsen which are being enrolled in the program for the first time. All three property owners are enrolling or re-enrolling their properties for the minimum 8 years as required by the Metropolitan Agricultural Preserves Act. Staff recommends that Council approve the attached resolution authorizing enrollment or re-enrollment of the referenced properties into the Metropolitan Agriculture Preserves Program. 3 CITY OF ROSEMOUNT i DAKOTA COUNTY, MINNESOTA ' RESOLUTION 1990- A RESOLUTION CERTIFYING LANDS ELIGIBLE FOR AGRICULTURAL PRESERVES WHEREAS, the Metropolitan Agricultural Preserves Act (Minnesota Statutes 473H.01 et seq. ) provides for establishing Agricultural Preserves; and h'giEREAS, the Act requires that to be eligible land must be planned for long-term agricultural use according to the local comprehensive plan adopted pursuant to Minnesota Statutes 473 . 851 (et seq. ) ; and WIiEREAS, the Act further requires such �roperty be zoned for long-term agricultural use with a maximum residential density not to exceed one unit per 40 acres; and WHEREAS, the City of Rosemount has planned and zoned certain areas as required by the Act. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby certifies that all of the areas so marked on the - map appended are eligible for designation as agricultural preserves. BE IT FURTHER RESOLVED, the Clerk shall file a copy of this resolution with the Metropolitan Council. ADOPTED this 6th day of February, 1990. Vernon J. Napper, Mayor ATTESTt Susan M.
