Recommended Action: Approval of Pine Bend Development Co. ist Addition
final plat subject to conditions (see Resolution) .
Enclosed with this review is a copy of the final plat for Pine Bend
Development Co. 1st Addition. As the City Council is aware, this plat
is being proposed to allow subdivision of three existing metes and
bounds description parcels to allow the Parker Communication A.M. Radio
Communications Facility to be developed.
Previous Planning and City Council action called for approval of the
Pine Bend Development Co. lst Addition preliminary plat subject to
dedication of street right-of-way for Fahey Avenue and Pine Bend Trail
and also dedication of 10 foot wide drainage and utility easements
abutting all public right-of-way. These changes as required by City
Council have been incorporated into the final plat.
The plat as proposed meets previous Planning Commission and City
Council recommendations with one exception. On the west side of the
plat a long narrow outlot is being shown. The outlot is approximately
20 feet wide and 1894 feet long. This outlot has resulted from finding
an error in the location of the west property boundary in preparation
of the final plat. The length and width of the proposed outlot would
make the property unusable. It could not be further subdivided at some
future date and meet subdivision requirements. The applicant has
indicated that the purpose of the outlot is to allow the 20 foot strip
to be conveyed to the abutting property owner, Willie Severson.
Apparently, based upon a wrongly placed fence location, Mr. Severson
has farmed the 20 foot wide strip for the last 20 years and has some
legal claim to ownership. Pine Bend Devlopment Co. owner of the land
in question has apparantly agreed to convey title of the 20 foot wide
strip of property (Outlot A) to Mr. Severson. To ensure that the
proposed Outlot A is not retained by Pine Bend Development Co. or that
at some point Mr. Severson attempts to sell it separate and apart from
his other holdings it is necessary that the City require a Lot
Combination Agreement to cause Outlot A to be legally combined with Mr.
Severson's property. Attached with this review is a copy of the Lot
Combination Agreement.
The Planning Commission has recommended approval of the Pine Bend
Development Co. lst Addition final plat subject to an executed Lot
Combination Agreement.

A RESOLUTION APPROVING THE PINE BEND DEVELOPMENT CO. 1ST ADDITION
FINAL PLAT
WHEREAS, the City of Rosemount has approved the Pine Bend
Development Co. lst Addition preliminary plat; and
WHEREAS, the Planning Commission of the City of Rosemount has
recommended approval of the Pine Bend Development Co. lst
Addition final plat.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of
Rosemount hereby approves the Pine Bend Development Co. lst
Addition final plat subject to:
1) an .executed Lot Combination Agreement causing legal
combination of Outlot A with property immediately
abutting to its west; and
2) conveyance of title of Outlot A to D.W. Severson
upon recording of the plat.
