Set Public Hearing for Utilities Easement Vacation, Lot 4 & S, Block 3,
B�Qback Sth Addition
This item is a result o€ a resident of Lot 5, Block 3, Broback 5th Addition
petitioning the City to vacate a utility easement located along iCs wes�.erly lot
line. The reason being that his existing garage currently encroaches about 6'
onto that easement. The awner of this lot, Mr. Gordon Oberg, wishes to move his
garage forward and attach it to his hause. He would not be encroaehing any
further than he is now with his proposal.
The I3tility Commission has reviewed this item and feel that it would be
approgriate, as I do, for a partial vacation of this easement. Tn addition, the
owner of Lat 4, Block 3, Broback 5th Addition has a garage that also encroaches
on the easterly portion of the easement on his lot. I would also recommend a
partial vaeation on that lot so that the owner does not have a title problem in
the future when he wishes to sell.
In order to get the appropriate notices published in th� paper and sent to the
utility companies, I would recommend Gouncil set a public hearing date for 3une
20, 19$9 to consider the partial vacation of utility easements on Lots 4 & 5,
Block 3, Braback Sth Addition.
