� �prove Payment for Shannon Parkway Easement, Projeet 171
This item consist of approving payment in the amount of $37,984.50 to Isadore and
Clarice Gergen for roadway easement for Shannon Parkway. The followin� will be a
brief background on this situation and the recommendation for Council to
consider.
In the fail of I987 the Council approved paying the Gergen family $8,500 per aere
for permanent easement and $850 per acre for temporary easement. The Gergen
family agreed to this price 'along with deleting watermain from 157th Street to
160th Street and also deferring assessments on 40 acres of property they owned
east of Shannon ParkwaX that was not classified as "Green Acre". In obtaining
the Gergens signatures far the easement agreement, it was necessary to have the
contract purchasers, the Rosemount Development Corporation (the developers of the
West Ridge Addition) sign off on their interest in the easement. This took '
several months to work out between the parties beeause the developers had
concerns about the project and easement. We finally came to terms with all the
parties and the easements have been signed and are now in the process of bea.ng
recorded. This is a brief explanation of why we are paying interest from the
date of our,original agreement with the Gergens on October 1, 1987 to the Council
meeting of January 17, 1989.
The total amount of payment to the Gergens is $37,984.50, which is arrived at as
follows:
$31,960.00 Permanent Easement
$ 2,456.SQ Temporary Easement
$ 3,568.00 Interest at 8% per addem from October 1, 19$7 thru
January 17, 19$9
$37,984.50 Tota1
Our City Attorney has heen working with us to resolve this matter and he's
recommending, along with Staff, that Council approve of this payment to the
Gergens for the Shannon Parkway roadway easement. '
