Several months ago tha City �ounCii considared an appeal to a Planning
�ommission decision which denied r�cognition as a buildable lat for � 2,28 acr�
parcel of praperty awncd by I?afe Helwig (�ec map), tt had been dctermincd that
ihe property in question had not been lega}ly divided and did not meet zorring
ordinance requirements at the time of division. City Council upheld the Planning
Commission decision but agreed to abate a special assessment piaced upon the
property in conjunction with improvements to County Highway 42, provided that
Mr. Helwig would sign an agreement waiving his right to chatlenge the right to
build on the property.
City Attorney, Dave Grannis, has prepared an agreement which would cause the .
C.H. 42 assessment to be waived subject to the owner of the property not
pursuiing residential development of it unless City regulations change to allow
such development. A copy of the agreement is enclased with this review.
Staff requests that City Council authorize execution of the attached agreement.

WEiEREAS, Owners own the property described on the attached
Exhibit ��A��� ("Property") i aild
WIIEREAS, residential development of the Froperty is not
permi�ted by the existing City Ordinances; and
WHER�AS, the Froperty has been assessed for ttie improvement
of County Road 42 ; and
WHEREAS, Owners h�ve requested th�t the City waive the
��sessment.
NOW THEREFORE, in consideration of this mutual covenant, the
parties aqree as follows:
1. The City herehy waives the assessment against the '
Property for County Road 42 Improvemer�t Project.
2 . Owners agree not to pursue residential development of

This letter will eonfa.rm that the Cynthia Kelley Q'Neill 1954 Trust
No. 1 and the Margaret H. Kelley 1953 Trust for the Hamm Foundation,
Inc. and Successor Benefieiaries has consented to the installati.on
of sanitary sewer and water on the property owned by �he above-
described Trusts . It is my understanding that the estimated costs
to be assessed against the Kelley property is to be as follows :
Sewer $ 94, 208.00
Water 64,436.00
TOTAL $15$,644,00
This letter will confirm that the aboue-described Trusts have agreed
not to appeal the assessment for the sewer and water pursuant to nur
discussion that the cost, not anl.y to the Tru�ts � but to the City oE
Itosemount � wou3.d be signifieantly higher if the sewer has to he
instal.led at a later c�ate. It is our understanding that Shannon
Parkway is to be extended this summ�r and our agreement to pay the
installation cost for sewer and water at this time will lower the
costs to the Trusts and the City of Rosemount . The above-descrihed
Trusts do not have immediate plans to sell or develop the property
and we do not want our consent to be cvnstrued as an indication that
we no langer intend to utilize the property �or agricul.tural pur-
poses ; however, we do fully expect that the property will be c�evel-
oped at some time in the near future.
