PUBLIC HEARING
Valley Oak Addition Replat-Phase III, Assessment Hearing
' This public hearing is for Council to adopt the attached assessment rall and
resolution after hearing any public concerns regarding the method of assessments
or the amounts of the assessments for this project.
As you may recall, Valley Oak Replat-Phase III consisted of 27 lots within the
Valley Oak Replat Addition. The publ.ic improvements that were instailed under
Project 180, City Gontract 1988-1 included watermain, sanitary sewer, storm
sewer, curb & gutter, bituminous surfacing and street lighting. The total
assessable cost amounted to $214,810,05 and were distributed equally among the 27
lots with the exception of the round off error of 21 cents being applied to Lot
5, Block 2.
Recommended action for Council to consider is to adopt the attached resolution
adopting the final assessments for City Project 180, Valley Oak Addition Replat-
Phase III.

VALLEY OAK ADDITION REPLAT-PHASE III STREET & UTILiTY IMPROVEMENTS

' WHEREAS, pursuant to notice duly given as required by law, the City Council has
' met, heard and passed upon all objections to the proposed assessment for Valley
� Oak Addition Replat-Phase III Street & Utility Improvements, Project No. 180, and
has amended such proposed assessment as it deems just.
NOW THEREFORE BE IT RESOLVED by the City Gouncil of the City of Rosemount,
i rtinnesota, as follows:

; is in Clerk's File 1989-20 is hereby accepted and shall constitute the
� special assessment against the lands named therein, and each tract of
I land therein is hereby found to be benefited by the proposed
improvement.
(2) Such assessments shall be as follows:

! a. The assessments shall be payable in equal annual installments
�--� extending over a period of five (5) years, the first of said
; installments to be payable with general taxes for the year 1990,
i collectible with such taxes during the year 1990.
ib. To the first instaliment shall be added interest at the rate of
i eight and seven-tenths percent (8.7%) per annum on the entire principal
amount of the assessment from the date of this resolution until
� December 31 of the year in which such installment is payable. To each
' subsequent installment, when due there shall be added interest for one
,� year at said rate on the unpaid principal amount of the assessment.
� c. The owner of any property so assessed may at any time prior to the
i certification of the assessment or the first installment thereof ta the
� County Auditor, pay the whole of Che principal amount of the assessment
; on such property with interest accrued to the date of payment to the
' City Treasurer, except that no interest shall be charged if the entire
� assessment is paid within 30 days from the date hereof; and such
property owner may at any time prior to November 15 of any year pay to
the Gounty Auditor the entire principal amount of the assessment
remaining due with interest accrued to December 31 of the year in which
