PUBLIC HEARING CHELSEA WOODS ESTATES - PRELIMINARY PLAT Developer Marv Eggum has proposed an S lot subdivision to be located on a forty acre parcel (Sieg Property) in Section 17, situated on the north side of County Road 38. Enclosed with this review is a copy of the Chelsea Woods Estates Preliminary Plat. The proposed subdivision has lot sizes ranging from approximately 3 - 7 acres in size. The subdivision meets density requirements (one home per five acres) for the Rurafi Residence District. The property is designated Rural Residential in the Camprehensive Guide Plan, however, a rezoning to Rural Residence District is required since the prpperty is currently zoned Agriculture. Enclosed with this review are copies of the Chelsea Wood Estates Preliminary Plat and a Resolution indicating requirements for its approvaL The subdivision meets all zoning and subdivision ordinance requirements with one exception. Lot 2, Block 2, daes not meet required frontage at setback of 150'. The Planning Commission has approved a variance to address this rnatter (see attached copy of Planning Commission Review review for Public Hearing - Eggum Variance). The Preliminary Plat has been distributed for review by required agencies {County Plat Commission, ISD # 196, Park & Rec., City Engineer). The Park and Recreation Director and the City Engineer have reviewed the Preliminary Plat and made the following recommendations. Dave Beechtold, Park & Recreation Director, has recommended that the City accept cash in lieu of land to meet park dedication requirements for the plat to be consistent with City policy regarding park dedication for large lot subdivisions. City Engineer Rich Hefti, has recommended that the Planning Commission condition action on the Preliminary Plat to detailed engineering recommendation which will be based upon review of plans and specificafions [or pnblic improvements associated with the project. The Dakota Counry Plat Commission has commented recognizing that because the project is accessed from County Road 38, it is subject to the Dakota County Contiguous Plat Ordinance. The County Plat Commission approved the location of the access, however, it did require that the plat indicated a restriction on any additional access to C.R. 38 and further that a permit be issued by the Dakota County Highway Department before the eommencement of any work. Every indication is that Mr. E�gum is proposing to build a first rate project. He has indicated that his intent is to constrnct homes whieh will fie s�ld far Uctwcen $30O,000 and $GO0,O00. The }�rc�roscd strccis in thc suhdivision havc been laid out in a manner to minimize tree loss on the site and also ta minimize the amount of grading which wilt have to take place. • � ` ' � • � . . �� • i The Planning Commission has recommended that the City Councit approve the Chelsea Woods Estates Preliminary Piat subject to the following: 1, Rezoning; 2. Park Dedication Recommendatians; 3. Engineering Recommendations; 4. Subdivision Development Contract. 5. Dakota County Plat Commission Recommendations. 8. CHELSEA WOOD ESTATES - REZONiNG The Planning Commission has recommended approval of the rezoning of Chelsea Woods Estates from Agriculture to RR Rural Residential. The Commission recognized that the proposed Rural Residential Zoning is consistent with the Comprehensive Guide Plan and that the proposed subdivision is in eharacter with surrounding development. The Planning Commission further recommended that the City Council withotd action on the rezoning until final plat approvat. This should be done just in case for some reason the project does not go ahead to avoid prezoning of the property. ` • • � Planning Commission - Planner Review - May 16, i989 Meeting PUBLIC HEARING - MARV EGGUM - VARiANCE PETiTION -CHELSEA WOODS ESTATES Marv Eggum, Developer of Chelsea Wood Estates has requested a variance to frontage requirements for Lot 2, Block 2 of that subdivision (see preliminary ' plat). The lot in quesEion is over 4 asres in size and frvnts on a cul-de-sac (Cabblestane Court), The proposed frontage fc�r the lot at setbaak (3Q' back) is approximately 85'. Frontage requirement for the RR District is 150'. All other lots in the subdivision meet or exceed frontage requirement. The lot in question does have 300' of frontage oa Covnty Road 38, however, therc wilt bs no access allowed from that highway. Staff is in agreement that the proposed lots boundaries are logical in respect to topography and vegetation. Lot 2 is pie shaped and is much wider than 85' in the area in which a home would be situated on the property. The variance request proposed could be accomplished through a PUD process however, since Chetsea Woods Estates is being proeessed as a standard subdivision, the Developer has been directed to pursue this variance. It would be possible to reconfigure lot boundaries so that Lot 2 would meet the 150' frontage requirement but there would be no benefit to the City or improvment to the_ subdivision if this was required. The hardship the developer would have in this case would be that it woutd be unreasonable for the City to mandate required frontage on Lot 2 since it would no better serve to meet the purposes of the zoning ordinance. Staff recommends that the Planning Commission approve the Variance request ot Marv Eggum. % � � � � � � � i � City of Rosemount Resolution 1989- 't..,.._ A Resolution Giving Approval to � the Chefsea Wcrods Estates Preliminary Plat and Setting 4ut the Conditions far Finat Approvai i WHEREAS, the City of Rosemount has received a Preliminary Plat for the Southeast Quarter of the Northeast Quarter of Section 18, Township 115, Range 19, known as Chelsea Woods Estates; and WHEREAS, the Flanning Commission of the Gity of Rosemount l�as reviewed said Preliminary Flat and submitted its recomrnendation tc� the City Council; and WHEREAS, the required public hearing and noti[ications have been completed. NOW THEREFORE BE IT RESOLVED, that the Cicy Council of the City of Rosemount approves the Shannon Oaks Preliminary Plat, subject to the fotlowing: 1) Rezoning; T 2) Park Dedication Recommendations; 3} Engineering Recommendations; 4) Subdivision Development Contract; 5) Dakota County Plat Commission Recommendations. � I Adopted this 6th day of June, 1989.
