This memo provide:; br�ck�round inf�rmation and recommended acti�n for Counci.l to cansicler. The owner and developer of tne Shannon Oaks subdivisian, Air. John Houston, has signed the attached "Waiver of Hearing" far this project. After meeting with l�lr. Houston he is in complete agreement with the eost to be assessed to his property. Rather than go throu�h the time and expense of a public hearing to consider adopting the aasessmen� roll, rir, Houston has elected to sign the "Waiver af Hearing" thereby waiving his rights to a publie hearing and accepting tl�e cost to be assessed as complete bene�it to this property. As you can see from the "Waiver of Hearing" we are assessing the total assessment cost against nine of the fiwelve lots that Atr. Houston platted as the Shannon Qaks Addition. The r�ason for this is that Mr. Houston sold three af tfie lots prior to the assessment hearing. Rather than have rtr. Houston post 1--1/2 to 2 times tlie pending assessment rate in escrow we allowed Mr. Houston to enter into an agreement with the City to spread' the total cost to be assessed to this project over 9 lots instead of the original 12. Recommended acticsn £or Council to consider is to adopt the attached resolution adopting the assessment ro11 for Project 185, Shannon Oaks Addition. ,, .,�_�.. ... . u � � i , ' . • � CIfiY OF ROSEMOUN'� ' RESOLUTION 1989 - A RESOLUTION WAIViNG Tl1E I1rARING 4N' '['tt� PROPOSF,n ASSFSSMFNT, AND Ant?PTTNG ASSFSSZ1rNT ROT,L SHANNON QAKS STREET II�IPROVEMENTS CITY PROJECT #1$5 WHEREAS, the City Council tias received a "Waiver of flearing" executed by the sole property owners for Shannon Oaks Street ImProvements, Project T$5, and has amended such proposed assessment as it deems just. BE IT FURTHER RESOLVED by the City Gouncil of Rosemount, ttinnesota: l. The assessment hearing has been waived because the property owners, The Great Stock Corparation, executed a "Waiuer of Hearing" which zeleases all their rights to a final assessment hearing and any assessment appeals. 2. Sueh assessment, in the amount of $155,279.37, a copy of which is in Clerk's Fil.e 1989-26 is hereby aecepted and shall eonstitute the speei.al �ssessment against the lands named therein, and each tract of land therein is hereby found to be benefited by the proposed improvement. 3. Such assessments shall be as follows: - �u a. The assessments shall be payable in equal annual installments extending over a period of five (5) years, the first of said installments to be payable with general taxes for the year 1990, collectible with such taxes during the year 1990. b.�� To`�ttie� first installment shall be added interest at the arate of eight and sev�n-tenths percent (8.7�) per annum an the enti,re principal amount of the as�essment fram the date of this resolution unta.l De�emher 31 of the year in which such installment is payable. To each subsequent installment, when due there shall be added interest foir ane year at said rate on the unpaid principal amount of the assessment. c. The owner of any property so assessed may at any time prior ta the certification of the assessment or the first installment thereof to the County Auditor, pay the whole of the principal amount of the assessment on such property with interest accrued to the date o€ payment to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the date hereof; and such property owner may at any time prior ta November 15 of any year pay t4 the County Auditor the entire principal amount of the assessment remaining due with interest accrued to December 3l of the year in which said; payment is made. , � � . � � • PAGE 2 RESOLUTION 1989- "�~ ,, .;i_�...... : . . 5.
