The revised assessment - hearing date would he June 6, 1989 at 8:00 p.m. Recommended action for Council to consider is to adopted the following resolution which rescinds Resolution i989-36 and adopt the revised resolution receiving cost to be assessed and ordering a publie hearing far June 6, 1989. I f � � • • � � I � I I CITY Ok' ROSEMOUNT ( � RESOLUTION 1989 - A RESOLUTION RESCiNAING RESOLUTION 19$9-36, I AND DECLARING COST TO BE ASS�SSED, ORDERING i ' PREPARATION OF PROPUSED ASSESSMENT, AND CALLING �� FflR HEARING ON THE PROPUSED ASSESSMENT VALLEY QAK ADAITIQN REPLAT, PHASE III UTILITY & STREET IMPRQVEMENTS r IPROJECT 180 ; IWHEREAS, the Gity Couneil at their April 4, 1989 regular meeting declared cost and ordered a hearing on the proposed assessments for Valley Oak Addition ReQlat, + Phase III Uti2ity & Street Improvements, City Project ��180, and; WHEREAS, Lhe City Engineer found calculations of expenses incurred to be in error in Resalution 1989-36; � WIiEREAS, a contract has been let for Valley Oak Addition Re lat h I p , P ase III Utility & Street Impravements, Project 180, and the contract price £or such � improvement is $115,815.59, and the expenses incurred or to be incurred in the � making of such improvement amaunt to $1�9,454.41 so that the total cost af the improvement will be $226,270.00. � NOW THEREFORE BE IT RESOLVED by the Gity Councii of Rosemount Atinnesota: � � i l. The portion of the cost of such improvement to be paid by the City is hereby � declared to be $11,7$8.95, and the portian of the cost to be assessed � against benefited property owners is declared to be $214,81�.Q5. � 2. Assessments shall be payable in equal annual installments extending over a period of 3, 5 and 10 years depending on type of improvements, the first of � the installments to be payable on or before the first rtonday in January, ) 1990, and shall bear interest at the rate of 2� points per annum above the j interest rate paid by the City for its bonds from date of the adoption of ; { the assessment resolution. ; I � 3. The City Administrator/Clerk, with the assistance of the Gity Engineer shall � forthwith caleulate the proper amount to be specially assessed for such ' i improvement against ever assessable lot Y , pieee or pareel of land within the distra.ct affeeted, without regard to cash valuation, as provided by law, and he shall file � capy of such proposed asseasment in his office for public inspection; and BE IT FURTHER RESOLY�D by the Gity Council of Rosemount, rtinnesota: 1. A hearing sha11 be heid an the 6th day of ,Tune, 1989, in the City Hall at 8:00 p.m. , or as soon thereafter as possible, to pass upon such proposed assessment and at such time and plaee all persons owning property affected by such improvement will be given an opportunity to be heard with reference ,�,_, to such assessment. The City Administrator/Clerk is hereby directed to cause a notice of the � j hearing on the proposed assessment to be published once in the official I; �^" newspaper at least two weeks przor to the hearing, and he shall state in the notice the total cost of the impravement. He shall also cause mailed notice I ta be given to the owner of each parcel ciescribed in the assessment ro11 not Iless than two weeks prior Co the hearings. _I 3. The owner of any property so assessed may, at any time prior to � certification of the assessment to the Count Auditor � y , pay the whole of the I assessment on such property, wa.th interest accrued to the date of payment, � ta the City, except that no interest shall be charged if the entire ' assessment is paid within 30 days fram the adoption of the assessment. He � may at any time thereafter, pay to the Gounty Auditor the entire amount of ; the assessment remaining unpaid, with interest accrned to December 31 of the i year in which such payment is made.
