�prove Assessment Abatement, Outlot A, 0'Leary's Hi11s 4th Addition
This item consist of abating an assessment placed an the future Outlot A in the
0'Leary's Hills 4th Addition resulting from the Shannon Parkway Improvements
Project of I988. The developer of the 0'Leary's Hills 4th Addition, Mr. Broback,
is closing on the purchase of about 16 acres from Mr. Dennis 0'Leary that will
� become the 0'Leary's Hills 4th Addition. The final plat and rezoning were
approved by Council at the April 4, 1989 meeting. That means that as soon as rtr.
Broback closes on the purchase of the property from Mr. 0'Leary and files the
plat at the County we will be the owners of Outlot A. Outlot A is being �
dedicated to the City for use as a ponding and utiliky easement.
This brings us to the reason for abating the assessment over Outlot A, whieh is
because tt�e developer will be dedicating the outlot for utility and drainage
purposes to the City at no cost. A past policy regarding assessing of publie
improvements has been that we do not assess ponding easements that the praperty
owner or developer would dedicate to us, In this case, we did nat have th�
� outlat dedicated prior to the assessment hearing so that we could make the
adjustment at that time. Now that` we wi11 be receiving this outlot, it would be
� consistent with our policy to abate the assessment against the 4.95 acres of
� Outlot A. The amount of the abatement would be $6,759.0$, which would increase
� the Citys portion of this project by the same amount.

; Recommended action for Council to consider would be to approve the assessment
t ` abatement over Outlot A of 0'Leary's Hills 4th Addition,
