Our Cansultants and Staff have inspected the project and find that the Contractor performed the work in accordance with the Contract Documents and City Standards. The City has made final payment to the Contractor, thereby closing the contract. Staff has tabulated all the overhead cost in conjunction with the constructic�n cflst to arrive at a total project cost. The eonsfiruetion cost and overhead cost are listed in the attached resolution along with the cost to be assessed. Recommended aetion for Councii to consider is to adopt the resolution which receives the cost of the assessed and order Staff to prepare the assessm�nt roll. . _' � . CITY OF R�SEPIOUNT RESOLUTION 1989 - A RESOLUTION DECLARING COST TO BE ASSESSED, ORDERING " PREPARATION OF PROPOSED ASSESSPI�NT, AND GALLING FOR HEARING ON THE PROPOSE� ASSFSSPi�NT VALLEY OAK ADDITION REPLAT, PHASE III UTILITY & STREE'F IliPROVEPIENTS PROJGCT 1F30 WfIrREAS, a contract has beerl :let f�r Valley (�ak Acldilio�i Rr_f�lai_, 1'li,�sc III Utility & Street improvements, Project 180, and the contract price £or sach improvement is $116,815.59, and the expenses incurred or to be incurred in the making of such improvement amount to $100,954.41 so that the total eost of the improvement will be $217,770.00. NOW THEREFORE BE IT RESOLVED by the City Council of Rosemount riinnesota: 1. The portion of the cost of such im�rovement to be paid by ttie Gity is hereby declared to be $10,9$8.95, and the portion of the cost to be assessed against benefited property owners is declared to be $206,781.05. 2. Assessments shall t�e payable in equal annual installments extending aver a period of 3, 5 and 10 years depending on type of improvements, the first of the installments to be payable on pr before the first Atonday in January, 1990, and shall bear interest at the rate of 2% points per annum above the interest rate paid by the City for its bonds from date af the adoption of the assessment resolution. 3. The City Administrator/Glerk, with the assistance of the City Engineer shall forthwith calculate the proper amount to be speeially assessed for such improvement against every assessable lot, piece or parcel of land withzn the district affected, without regard to cash valuation, as provided by 1aw, and he shall file a copy of such proposed assessment in his office for public inspection; and BE IT FURTHER RESOLVED by the City Council of Rosemount, rtinnesota: 1. A hearing shall be held on the 16th day of Ptay, l9$9, in the City Ha21 at 8:00 p.m. , or as soon thereafter as possible, to pass upon such proposed assessment and at such time and place ail persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The City Administrator/Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and he shall state in the notice the total cost of the improvement, He shall also cause mailed notice to be given to the owner of each parcel described in tlie assessment roll not less than two weeks prior to the hearings. « � • Resolution 1989 - Page 2 3. The owner of any property so asse'ssed may, at any time prior to certification o€ the assessment to the Gounty Auditor, pay the whole o£ the assessment on such property, with interest accrued to tt�e ciate of payment, to the City, except ttiat no interest shall be charged if the entire assessmen� is paid within 30 days from the adoption of the assessment. He may at any time therea£ter, pay to the �ounty Audztor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 0€ the year in which such payment is made. Such payment must be made before November 15 or interest will be eharged through December 31 of the succeeding year. ADOPTED this 4th day of Ptay, 1989.
