BITUMINOUS MATERIAL8 INC. - MINING PERHIT RENEWAL
Bituminous Materials, Inc. has requested renewal of its mininq
permit for an 80 acre site located immediately sauth of Solberg
Aggregate on Trunk Highway 56. City Council has previously
approved a l0 year mining plan which requires annual renewal of a
mining permit.
Since the original permit was issued early this year no mining has
been conducted on the site. BMI has indica�ted tha� i;t is their
.intent to initiate mining in the Spring of 1994 following the
previously approved operatians/phasing glan. Enciosed with this
review are reduced copies of the follawing maps: Existir�g
: Conditions, Operations/Phasing Plan, and End Use Grading Plan.
Also enclosed is a copy of the List of Conditions placed upon the
mina.ng permit.
The property proposed for mining has recently been sold ta Koch '
Refining Co.' The lease BMI has to mine sand and gravel transferred '
with the sale. Since the property owners (Astlefard and Burger}
were required to sign the original Niining Permit �onditians it is
the recommendation of Staff that a new set of cor�ditions be
executed with signatures of representatives of both BMI and Koch.
Enclosed with this review is a revised list of Mining Permit
Conditions which reflect the new ownership and indicated a mining
permit expiration of December 31, 1990. ,

The Planning Commission considered this item at its last meeting
and recommended approval of renewal of the BMI Mining Pe�rmit
subject to execution of the new set of Mining Permit Conditions.

Conditlons of Bituminaus Materials, Inc. Mlning Permi#
A. That Bituminous Materiais, Inc. {hereinafter "the Operator") and Koch
Refining Campany (hereinafter "the Uwner") �ign a written consent to
these conditions binding Ehemselves and their successars or assigns to the
conditiofis of said permit. Futthermare, that this mining permit may not
be transferred or assigned to another party without written permission
from the City o[ RosemounL
B. That this permit is granted for the area designated as Phase 1, on Exhibit
B (UPERATiONS/PHASiNG PLAN) which is attached h�reto as one af the
exhibits dated September 30, t988. tt is recc�gnized that Exhibit A
illttstr�tes a Sand And Qr�vcl Minin� ()per�tion:tfPheain�{ P1n» ��r arn 80
acre parcel of prc��crty legally described �s: Sectinn 24, Tawnship 1.15,
Range 19, the Nor�h 1/2 of the S�utheast 1/4. Also attacfied hereto are
Exhibit A (EXtSTING CONDITIONS ON SITE) and E�chibit G (END USE
GRADiNG PLAN).
C. TMat Exhibits A, B, and C together with a description of Che mini»g
operalion incladed in an Environmental Assessment Worksheet �repared [or
the project (BMI P{ant No. 2 - EAW) on file with the City oi Rosemount;
provide a 10-year sand and gravel mining plan subject to this lisi of
conditions and sufiject to annuai renea+nat at the end of each calendar
year (December 31st).
D. That the term ol' the permit shafi extend [rom the date af issuance
through December 31, I990 unless revoked prior to th�t ior fail�re fo ,
cc�mply with the �errnit requirements. ThereaPter, any application for
renewal of the permit shatl be made at least sixty (6Q) days prior to the
expiration date. A mining �ermit [ee of $250.00 shall be paid to the City •
of Rosemount.
E. That all required permits from the State 4[ Minnesota, County af Dakot�
and City of Rosemount (hereinafter "City") or any oi their �gencies be
obtained and submitted to the City �rior to the issu�nce oi the permit,
That fatinre by the �nerator to comply with the terms and conditions af .
any of the permits reqnired ander this paragraph shai) be grounds for the
City to terminate said mining permit.
F. That the final grading for the permit area shall bc completed in
accordance with the attached exhibits and any other conditians as may be
imposed by the City irom time to time.
F. Ail gravel trucks shall enter and exit the mining ares fram State Ttunk
Highway No. 56. tt shai� be the O�eratc�r'A res�onaibitity to abtein eny
easements necessary for ingress and egress. The incation oi the easetntnts
fnr ingress and egress shall be apnroved by the City and a plan for dnat
contrnl aheil t�e �ubmitted end e�proved by ti+e City.
G. That the surface water drainage �F the mining areA shall not be altered ao
as to interfere or aFfect the eatural drainage of adjacent properEy. •

I. That all costs o[ processing the �ermit, including but not limiied ta
planning fees, engineering fees and legal fees, shatl be paid by the
Qperator prior to the issuanee o[ the permit. That the Operator reimburse
the City for the cost c�[ periodic inspeclions l�y the Cily �nginetr 4r any
othcr City em�loyce !or the pur�o�e of insuring that conditi�ns of the
permi! are bcin� satisficd. That the Oper�tc�r agrces Eo rcimburse the City
for any other costs incurred as a resuit af the granting o[ enforci�g of
the permit.
J. That the daity hours of operation for the mining area shall be limi�ed to
7:00 a.rn. to 5:00 p.m., subject, however, to being changed by the City
Councit.
K. That the npetatar deposit with the City Clerk a snrety bond or cash
escrow in the amount oE Fifty Thousand �nd no/100 (�SO,OOO.OQ} Daltaxa in
favor of the City. The required surety bond must be:
(1) With good and sufficient sarety by a surety company autlrorized fo do
business in the State of Minnesc�ta with the right of the surety
c�mpany to cancel the sarne npon thirty (30) days written notice to
the permit hotdcr and the City.
(2) Satisfactory to the City AtEorney in form and substance. � �
(3) Conditioned that the Operat�r will faithfutly comply with all the
terms, conditions and requircments oi the permit; all rules,
regulations and requirements pursuarst to the permit and as reqn�red
by the City and all reasonabic requirements of the Engineer or other
City of[icials.
{4) Conditivned that the Operator wi1T secure and hald Eht Ciiy and its .
officers harmless against any �nd all claims, or for which the City,
the Council pr any City crfficer may be made liak►1e by reason ot �ny
accident or injury to pers�ns or property through the iault at ths
Opexator. •
(S) The surety bond or eash escrow shall remain in effect from January
1, 1990 untii June 30, 1991.
Upon thirty (30� days notice t� the permit hoider and the sutety comp�ny,
the City may reduce or increase the amonnt of the bond or cash escrow
during the term of this permiE in order to insnrt that Eht City is
adequately protected.
L. That the Operator turnishes a certificate of comprehensive generat liability
insurance issued by insurers di�ty ticensed within the State of Minnesota in
an amount of at teast five Hvndred Thousand and no/100 (�SOtT,000.00)
Dollars for injury or death oi any one �erson in any one occurreace,
bodily injury Hahility in an amount c�i' at lea�st nne Million and no/tQ0
(�1,Q0(?,OpO.AU) Dollars and damage li�bitity in an amount oF at lcast Two
Hundred Fi(ty Thousand and no/1Q1� ($250,400.�(t) Daltars arising out af any
one occurrence. The poticy of insurance shall rrame the City as co-,
insured and shafl remain in e([ect from Ja�nuary ], 1990 nntil June 30,

shatl be updated by the Operator and pravided to the City Clerk. .
N. TMat constrvction of any ponding areas or wash piants shal) require
' additional City Coancil approval and noti fication vf adjacent property
owners.
O. That the Operator shall hold the City harmiess from alt claims or causes
of action that may result from the granting of the permit. That the
nperator shall indtmnify the City for sll costs, damages or axpenses,
inclnding but not limited to attorne�!'s fees which the City may pay at
incur in conseqoence of such claims.
P. That the Operator comply with such other reguirements of the City
Councii as it shal) from tim� to time deem proper and neeessary �or the
protection of the citizens and generat welfare oi the commpntty.
Q. Compleie mining and reciamation is required in phases 1, before any
additiona) mining is authorized. Modifications or expsnaion o[ the mining
s�reas must be ap�raued in writing to thc �ity.

That Koch Refining Co., property owner, hereby consents and agrees to
the foregoing conditions o[ said mining permit.
