Receive Cost to be Assessed/Order Assessment Roll, Shannon Qaks Addition,
Project 185
This item consist of Council receiving all the construetion and overhead cost
associated with Project 185, Shannon Oaks Street Improvements by adopting the
attached resolution.
You will note the attached resolution is slightly different because the develoger
of the Shannan Oaks Addition, Air. John Houston, is requesting to waive his rights
to a final assessment hearing and any assessment appeals. Pir. Houston wzshes to
take care of ail the assessments as quickly as possible. Staff reviewed this
request with our City Attorney, Pir. Dave Grannis, and he indicated there is no
problem with rtr. Houston signing a Waiver of Hearing form in which Air: Houston
waives his rights to a public hearing and agrees not to appeal any of the
assessments. Attached to this memo is a copy of what rtr. Houston will be
signing.
Reeommended action for Council to consider is to adopt the attached resolution
reeeiving the cost of the assessed, and ordering the preparation of an assessment
roll, and approving the Waiver of Hearing subject to the developer submitting a
signed Waiver of Hearing.

PREPARATION OF PROPOSED ASSESSMENT
SHANNON OAKS STREET IMPROVEMENTS

to Ue incur�ed in tlie making of such improvement amount to $72,051 .80 so that the
total cost of the improvement will be $262,040.22.
BE IT RESOLVED by the City Conncil o€ Rosemount riinnesota:
1. The portion of the cost of such improvement to be paid by the City is hereby
declared to be $106,760.85, and the portion of the cost to be assessed
against benefited property owners is declared to be $155,279.37.
2. Assessments shall be payable in equal annual installments extending over a
period of 5 years, the first of the installments to be payable on or before
the first Ptonday in January, 1990, and shall bear interest at che rate of 2%
points per annum above the interest rate paid by the City for i�s bonds £rom
date of the adoption of the assessment resolution.
3. The City Admix�istrator/Clexk, with the assistance of the City Engineer shall
�-- forthwith calculate the proper amount to be specially assessed for such
improvement against every assessable lot, piece or parcel of land within the
district affected, without regard to cash valuation, as provided by Iaw, and
he shall file a copy of such proposed assessment in his office for public
inspection; and
BE IT FURTHER RESOLVED by the Gity Gouncil af Rosemount, riinnesota:
1. The owner of any property so assessed may, at any time prior to
certification of the assessment to the County Auditor, pay the whole of the
assessment on such property, with intexest accrued to the date of payment,
to the City, except that no interest shall be charged if the entire
assessment is paid within 30 days from the adoption of the assessment. The
owner may at any time thereafter, paq to the County Auditor the entire
amount of the assessment remaining unpaid, with interest accrued to December
31 of the year in which such payment is made. Such payment must be made
before November 15 or interest will be charged through December 31 of the
succeeding year.
