SUBJ: Forfeited Lands
Attached is a copy of a letter from the County Auditor and "classification certificate"
for forfeited or tax delinquent parcels. The county certifies such delinquent parcels
each year and ' submits the list to the state for eventual public sale. Delinquent
owners are given one final opportunity to pay all back taxes prior to the sale.
The state requires that municipalities also approve the classification as non
conservation lands, which will allow the public sale to commence. It is also an
opportunity for municipalities to identify any parcels of public interest. If the
delinquent owner does not opt to pay back taxes, a municipality has the option to
"acquire" the parcel prior to public sale.
There are three parcels on this year's listing in Rosemount. One is a one -acre parcel
contiguous with an exception to the White Lake Acres subdivision. it is an illegal
non -conforming parcel of record. It wag split off from a larger parcel in the 1.970s"
without authorization by the City. We would not issue a building permit on the
parcel, as a result.
This parcel, is contiguous with Outlot A, White Lake Acres, which was "acquired" by
the City through the same forfeiture process. Cities may "acquire" such parcels, at
no cost, provided they are dedicated for public purpose. Outlot A was granted to the
City, as was Outlot B, for storm water holding purposes. I would recommend the City
delete this new parcel from the list and fill out the attached request form. Our
public purpose would be storm water holding/street right-of-way.
The other two parcels are contiguous to each other and located at Pine Bend Trail
and TH 55. One of the parcels contains the former Ruan Trucking building. This
building is being leased to Koch Refining Co., Cardox Inc, and a trucking firm. I am
quite sure the present owners will pay up prior to a public sale. The City could have
a possible public purpose, if a fire hall in Pine Bend was a reality. The two
properties have a combined assessed value of about $200,000. if the City did attempt
to acquire the properties, they would become tax exempt rather than tax delinquent.
In summary, I would argue there is a definite public interest and purpose in the
"White Lake Acre" parcel Unless we can verify a definite public purpose on the
other two parcels, the City should classify them as non -conservation forfeited lands.
Once any forfeited lands are publicly acquired they must remain as public property
indefinitely. The attached forms require action by the City Council and signatures by
the Mayor and Administrator/Clerk.

At the County Board meeting held on December 29, 1987, the lands that have
been forfeited for non payment of taxes for the years 1981 and 1983 were
classified as non -conservation lands, in preparation for the sale that will
eventually be held on these lands. A list of these lands has also been
sent to the. Department of Natural Resources for their approval.
Please have your township or city council approve this classification
on the enclosed sheets and return the form to this office as soon as possible.
If your municipality wishes to acquire any of these parcels, please contact
this office for the proper form. The previous owner does have until one week
before the sale to repurchase the property.
