WENSMANN ADDITION - VACATION OF DRAINAGE AND UTILITY EASEMENTS Wensmann Additions Planned Unit Development is a 206 lot subdivision of single family homes which was approved by the Planning Commission and City Council in September of 1987. The PUD was designed to be platted in phases and the approvals in September included platting of Phase One (Wensmann Addition). Included with this review are the following items to provide information to the Commission: The Developer has found that he cannot accommodate the home width he desires on the south side of 153rd Street West - Block 4 Wensmann Addition with the 82' wide lots as currently platted. The removal of one lot is proposed which would create 8 wider lots in Block 4 (minimum frontage of 90 feet. The lots created by the proposed reconfiguration would exceed the minimum requirements established in the PUD Agreement for Wensmann Additions as well as exceeding minimum requirements of the City's Zoning ordinance. The Developer had requested that the rearrangement of lots be accomplished by a simple lot division, however, the City Engineer has suggested that the lots to be changed should be replatted to avoid complex legal descriptions and confusion over property boundaries. Staff is recommending that these nine lots of Block four be replatted as part of the second phase of Wensmann Additions (see PUD Plan) which the Developer is planning to plat this spring. Two steps must be undertaken to allow the Developer to construct homes on these lots prior to the platting of phase 2. First, the easements attached to the lots in question must be vacated which requires a recommendation by the Planning Commission, a Public Hearing, and approval by City Council. Secondly, an agreement must be made between the Developer and the City which will allow building permits to be issued prior to final plat approval of phase 2. The lots in question could not be sold until the phase 2 plat was recorded. To initiate this change a Public Hearing date for the Vacation of Drainage and Utility Easments in Wensmann Addition, Block 4, lots 1-9, must be set by City Council. AV's 1 Location Map 2.
