MINNESOTA 55068 oc7 rnoun 612 -423-4411 TO: Mayor Hoke Councilmembers: Napper Oxborough Walsh Wippermann FROM: Stephan Jilk, Administrator/Clerk DATE: March 10, 1988 RE: Adventure Zone Permit Renewal Gentlemen: Attached are several items for your reference to review in consideration for the renewal of a permit for the operation of the "Adventure Zone". This is an adult war game with the use of paint splat type pistols. This operation has been going on for a few years now with no problems exhibited to the city and apparently quite successful. The terms of the agreement, as attached, are the same ones approved last year. The form of the agreement is also the same as last year. I would recommend its approval. P E R M I T PERMIT issued this 1 day of April , 19889 by the CITY. OT' ROSEMOUNT (the "City") to Lee Moeller d/b/a THE ADVENTURE ZONE ("Moeller"). I. The City hereby issues a permit for the "Adventure Zone Game" in accordance with the definition and rules set forth on the attached Exhibit "A". 2. This permit is issued subject to the following conditions: a. The permit is valid only on Tax Parcel Number 34-0200-010-25. b. The permit holder shall take out and maintain in force general liability insurance for a least One Million Dollars ($11000,000). The form of the policy and the insurer shall be subject to approval by the City Administrator. The City shall be named as an additional insured on the policy. The policy shall further provide that the City shall be given ten (10) days advance notice of cancellation. Proof of this insurance (Certificate of Insurance) will be presented as part of approval process of the permit. C. The hours and days of operation shall be limited to the following: Monday through Sunday 10:00 A.M. to dusk. d. The permit for operating shall continue from April 1, 1988, until October 31, 1988. e. No building or other structure may be erected on the site. f: The permit holder shall police the -area for litter after each game and shall insure that a nuisance is not created as a result of noise, littering, traffic, or disorderly conduct. g. Beer, wine, and intoxicating liquor is prohibited. � 3. This permit may be revoked for violation of its terms or violation of any ordinance or statue. Maximum players on each team would be 15, with approximately 8-10 cars. The average group will probably be considerably smaller, but there is ample parking well off the highway. As far as advertisement goes, we will advertise in the papers, but no directions will be given to the field. Once a deposit is made for a group, maps to the team leaders will be sent to them with their confirmation sheet. The tentative playing times are from 10:00 A.M. to 1:00 P.M. and 2:00 P.M. to 5:00,P.M. on Saturdays and Sundays, from April lst through September, Tuesday from 10:00 A.M. to 1:00 P.M. or 6:00 P.M. to 8:30 P.M. or dusk, Wednesday leagues are from 6:00 P.M. to 8:30 P.M. or dusk, and Fridays from 10:00 A.M to 1:00 P.M. Tuesdays and Fridays would be used very little, just for shift workers as a relief valve. Players are advised to arrive 1/2 hour before their scheduled time so all safety rules can be explained to them and to familiarize everyone with the boundaries. At the end of each session each day, the whole area will be policed for expended CO2 cartridges, pop cans and other debris. The lot will be empty by 6:00 P.M each day, with the exception of Tuesdays and Wednesdays ( 8:30 P.M. or dusk) and no partying will be allowed during or after the games. Our motto is take nothing but pictures, leave nothing but footprints. When the players arrive and after their orientation, they will be handed out safety goggles, one CO2 cartridge, water -colored pellets and a CO2 pistol. They are then walked to their prospective ends of the field to their home flag. Whent the field judge blows the whistle, pkAy commences with each team trying to out -maneuver each other to capture their flags. After a player is "splatted", he goes off a designated neutral zone, where he will wait until one team captures the other team's flag and brings it to their home end. The pistols' effective range is only 50=feet. The paint is a new - style water color which is biodegradable and is harmless to plants, Oeople and animals. A letter of intent will follow for our $1,000,000.00 liability insurance. Our current policy is good through July, so upon renewal, the letter of intent will come. • 0 February 13, 1987 Page Two Again, I would like to point out that this is silly harmless game for "Big Kids", men and women alike who can get out for a good work- out and a real fun time. You are welcome to come and watch a game if you like and maybe even sign ftp yourselves. As like last year, we hope things go nice and smooth. Wear your camouflage gear if you wish and feel free to bring a canteen. You may purchase additional CO2' cartrid res and tubes Of paint if you wish. All mateiiials must be returneg to The Adventure Zone at the end of play, except; CO2 cartridges and paint tubes, which are not returnable. You will be invoiced for- any lost, damaged, or abused playing equipment. The rules of The Adventure Zone, Game as set forth will be re- viewed before the game starts. Additionally, Tile (adventure Zone has its own code of' conduct: 1. Safety first! Goggles supplied by The Adventure Zone must be worn at all times on the field. NO Ii'X(1L1.'TI( \JS. 2. No head shots! The first time is a warning -the second time your out for -tile beet. They won't count as a hit so don't give your position away. 3. All calls by field judges are final. Including without limitation, the manufacture, selection, delivery, possession, use, operation of the equipment and the natural environment.
