MINNES0IA 55068 _: • oser�oun 612-423-4411 TO: Mayor, City Council and City Administrator FROM: Dean Johnson, Director of Community Development DATE: March 11, 1988 1: SUBJ.- Transit Opt Out - Joint Powers Agreement Attached are copies of a Joint Powers Agreement and adopting resolution, which will formally trigger the start-up of the "Area Needs Assessment/Transit Study," on behalf of the six cities involved. A brief summary of the agreement is as follows: 1. The cities agree to prepare an RFP for outside assistance to complete the study. 2. The cities agree to request 100% funding from the Regional Transit Board (RTB). 3. The application process and response from the RTB will be determined prior to awarding a contract for service 4. If the grant is denied the cities agree to proceed with the study and share in the costs according to the percentage contribution shown on Exhibit "A". 5. Management of the study will be conducted according to Exhibit "B". 6. Additional administrative requirements, such as awarding a contract and disbursing monies, will be agreed upon in the future. The actual day to day activities will be conducted by the Technical Work Group (TWO), consisting of planners and administrative assistants from the six cities. Recommendations from the TWG go to the Program Management Team (PMT), which is made up of the six city administrators. The PMT and/or TWO are responsible for informing and securing action from the respective city councils. (The Program Advisory Team will consist of the TWG and representatives from the RTB and the consultant.) The TWO presented the Joint Powers Agreement to the PMT on March 1. Steve or I will be able to answer any additional questions you may have.' a AREA NEEDS ASSESSMENT/TRANSIT STUDY FOR THE CITIES OE PRIOR LAKE, SAVAGE, ROSEMOUNT, APPLE VALLEY, BURNSVILLE & EAGAN JOINT POWERS AGREEMEtd Y THIS AGREEMENT made this day of 1988, between the cities of Prior Lake, Savage, Rosemount, Apple Valley, Burnsville and Eagan; WHEREAS, the cities of Prior Lake, Savage, Rosemount, Apple Valley, Burnsville and Eagan are Minnesota' municipal corporations duly organized and licensed under the laws of the State of Minnesota; and WHEREAS, each of the cities desires to coordinate a study to evaluate transit needs and to provide for the best transit system; and WHEREAS, the cities of Prior Lake, Savage, Rosemount, Apple Valley, Burnsville and Eagan historically have had a long and positive working relationship. The joint pursuit of a transit study and need assessment provides the cities with `a unique opportunity to work together in a new and exciting manner; and WHEREAS, the development of an overalll,' transit study and need assessment affords all parties benefits that would not otherwise be provided and that will be valued for the years to come; and ,i 1 �.t WHEREAS, combining the transit study and needs assessment will, through the Minnesota Joint Powers Act (M.S.A. §471.59), allow the cities to save tax dollars and provide a mode comprehensive study of t, the transportation p problems of the entire area, and the needs of individual cities. WHEREAS, each of the parties has submitted a letter of intent to apply for assistance pursuant to Minnesota Statutes Section 473.388, Subd . 2; and WHEREAS, each of the parties desires to apply for assistance pursuant to Minnesota Statutes Section 473.388, Subd. 3; NOW THEREFORE, the parties agree as follows: 1. The parties jointly approve the preparation of a request for proposal to perform the requested need assessment and transit study. 2. The parties jointly agree to submit an application to the Regional Transit Board for a grant for 100% of all the costs necessary for the needs assessment and transit study. 3. That the intent of said joint application is to secure verification that the Regional Transit Board will approve the funding of the needs assessment and transit study prior to actual commencement thereof. 4. If the Regional Transit Board fails to provide a grant or provides an insufficient grant, the parties shall contribute to the cost of the area needs assessment and transit study in a manner consistent with Exhibit "A" attached hereto. 5. The area needs assessment and transit study shall be completed at the direction of each of the parties through its 2 J.. �.1 representatives as described in the organizational chart attached hereto as Exhibit "B". 6. Once the method of financing the atea needs assessment and transit study has been established, an appropriate administrative body should be created by further agreement to carry out the area needs assessment and transit study and;, administer the funds necessary for completion. (S E A L) Notary Public _ 5 0"W-1 EXHIBIT "A' TRANSIT NEEDS ASSESSMENT STUDY ESTIMATED COSTS PER CITY % of Total $60,000 City Population Population Study Costs Apple Valley 29,776 21.6 $ 13,100 Burnsville 44,353 32.2 19,500 Eagan 39,225 28.5 17,250 Prior Lake 10,153 7.4 4,500 Rosemount 6,847 5.0 3,050 Savage 7,400 5.4 3,250 Total Population 137,754 100.0 EXHIBIT "B" APPLE VALLEY EAGAN BURNSVILLE CITY COUNCIL CITY COUNCIL CITY COUNCIL SAVAGE ROSEMOUNT PRIOR LAKE CITY COUNCIL CITY COUNCIL CITY COUNCIL t Program Management Team i Technical Work Group Program Advisory Team CITY OF ROSEMOUNT RESOLUTION 1988- A JOINT RESOLUTION FOR AREA NEEDS ASSESSMENT/TRANSIT STUDY WHEREAS, the Minnesota State Legislature pursuant to Minnesota Statues (M.S.) 473.388 has provided Minnesota cities with the authority to investigate alternative forms of transit services and systems, this authority commonly referred to as transit "Replacement System" or "Opt -out"; and WHEREAS, pursuant to M.S. 473.388, Subdivision Z.C., the six cities of Apple Valley, Burnsville, Eagan, Prior Lake, Rosemount and Savage have submitted a "Letter of Intent" to apply for assistance on or before the July 1,1985 deadline; and WHEREAS, the 1987 Minnesota State Legislature pursuant to M.S. 473.388, Subdivision 2, has authorized the termination of replacement transit service by July 1, 1988, or by July 1, 1989 if a transportation evaluation study is being conducted; and WHEREAS, the cities of Apple Valley, Burnsville, Eagan, Prior Lake, Rosemount and Savage must initiate a Transit Need Assessment Study before July 1, 1988 to investigate alternative forms of transit services and systems, and to comply with "Replacement Service" deadlines as enumerated in M.S. 473.388, Subdivision 2, Paragraph C, Clause iii. NOW THEREFORE, BE IT RESOLVED that the City Councils of Apple Valley, Burnsville, Eagan, Prior Lake, Rosemount and Savage agree to adopt the Area Needs Assessment/Transit Study Joint Powers Agreement attached hereto. BE IT FURTHER RESOLVED that the City Councils of Apple Valley, Burnsville, Eagan, Prior Lake, Rosemount and Savage hereby direct the appropriate City staff members to commence with activities that result in eventual preparation of a Transit Need Assessment Study.
