7d. FINE BEND DEVELOPMENT COMPANY GRADING PERMIT APPLICATION
The Pine Bend Development Company has applied for a grading permit
for a project which will involve removal of sand and gravel, crushing
of aggregate to prepare material for use in highway construction and
regrading of the proposed site. The proposal which has been
submitted involves removal of 100,000 cubic yards of sand and gravel
and regrading of the site, which is approximately 18 acres in size
and is located east of Emery Avenue, south of County Road 38 and
north of the proposed section of County Highway 42 which will be
constructed this spring (see location map). Included with this
review is a copy of the grading plan submitted by Pine Bend
Development Company which illustrates final grade upon project
completion.
The intent of the applicant is to market the sand and gravel which
will be removed to the contractor who will be performing the
construction work on County Highway 42. Community Development Staff
has reviewed the proposal and has found that the proposed site
represents a logical location to remove sand and gravel for the
highway project. A substantial cut (up to 15 feet) will be required
for the new stretch of C.H. 42 to meet its proposed grade through the
applicants property. The proposed grading plan for the property will
basically smooth out the property making it more useable for
agriculture or some other use should current zoning of the property
ever change. The proposed plan adequately handles the channeling of
surface water runoff and the plan suggests that erosion control
measures will be undertaken in conjunction with the Highway
Construction Project. The Applicant has shown a willingness to work
with Community Development Staff in submitting a plan which staff
finds finds acceptable with no major concerns.
This proposal was reviewed by the Planning Commission at their April
5th Regular Meeting and was approved subject to the following
conditions:
1) Permit limited to the County Road 42 improvement contract;
2) Notification to surrounding property owners to make them aware
of grading activity and to allow comment when on Council Agenda;
3) Authorization by Council for on-site crusher;
4) Seasonal permit related to project duration;
5) Total site restoration by fall, 1988;
6) Letter of Credit to be determined by City Engineer.
Council action required on this item is a simple motion.
