W. �__A�semount ROSEMOUNT, MINNESOTA 55068 612--423-4411 let TO: CITY COUNCIL FROM: MICHAEL WOZNIAK, ASSISTANT CITY PLANNER DATE: APRIL 15, 1988 SUBJ: REVIEW OF AGENDA ITEM 7e. 7e MICHAEL & LOIS DOLL - LOT COMBINATION Michael and Lois Doll have requested that they be allowed to combine two lots located in Mickelson's First Addition (see location map) for the purposes of construction of a home with an on-site sewer system which would straddle the boundary between the two lots. Lots 1 and 2 Block 2 of Mickelson's First Addition both have frontage on County Road 38, however only one access point (lot 1) has been allowed by Dakota County. These are large lots (greater than 2.5 acres) which are sloped such that they drop off sharply from County Road 38 and both lots contain wetland areas. Given the difficult access to these lots it makes a great deal of sense to permanently combine the lots to create one home site which would allow a home or septic system to straddle the boundary between the lots Community Development Staff will present the Planning Commission Recommendation regarding this lot combination at the meeting. Also included with this review are copies of a Lot Combination Agreement which must be executed and a Resolution which would authorize execution of the agreement. i CITY OF ROSEMOUNT RESOLUTION 1988- A RESOLUTION APPROVING A LOT COMBINATION WHEREAS, the City of Rosemount has received a request from Michael J. and Lois A. Doll to combine the following described lots: I Property A: Lot 1, Block 2, Mickelson's First Addition i Property B: Lot 2, Block 2, Mickelson's First Addition WHEREAS, the Planning Commission has recommended approval of the indenture for combination of Properties A and B. NOW THEREFORE BE IT RESOLVED, the City Council of the City of Rosemount approves the indenture combining Properties A and B between the City of Rosemount and Michael J. and Lois A. Doll, husband- and wife, hereinafter referred to as "The Dolls," and City of Rosemount, a Minnesota municipal corporation in the County of Dakota and State of Minnesota, hereinafter referred to as "City", WITNESSETH: WHEREAS, the Dolls are owners of the following described premises, to wit: Property A: Lot .1, Block 2, Mickelson's First Addition. Property B: Lot 2, Block 2, Mickelson's First Addition. WHEREAS, the said Properties A and B are adjacent to each other and have a common boundary line. NOW, THEREFORE, the parties do hereby covenant and declare that said Properties A and B be, and the same hereby are, subject to the following restrictions, to wit: 1. That neither of said Properties A and B be sold, transferred, encumbered or otherwise alienated separate and apart from the other. It is intended hereby that the ownership of Properties A and B shall be considered to be the ownership of a single integral tract and that the said boundary lines between said properties shall be deemed to be nonexistent. 2.
