Connemara Trail -Street Assessment Hearing, City Project #169
At the March 17, 1988 meeting Council adopted the assessment roll for the
Connemara Trail Street Improvement Project and ordered an assessment hearing to
be held on April 19, 1988. The City has published and mailed all the legal
notices of this meeting along with the proposed amount of the assessment.
In recent discussion with U. S. Homes representatives they indicated that it
would be their preference to pay the entire lateral benefit assessment over three
(3) years by means of a repayment agreement. This agreement would be backed by a
Letter of Credit in the amount of the assessment to the entire Country Hills 2nd
Addition. Our City Attorney is working on this agreement and we hope to have an
executed agreement available along with an acceptable Letter of Credit. At this
time there is some doubt if U. S. Homes will be able to supply a Letter of Credit
from an acceptable commercial institution. For Councils information, U. S Homes
proposed on submitting a Letter of Credit from a financial institution that is
owned by U. S. Homes. This was not acceptable to the City because we do not feel
that it provides the City with adequate protection. We are requesting a Letter
of Credit from a separate institution.
The main reason that U. S. Homes wishes to enter into a payback agreement with
the City is because they want to spread the cost for Connemara Trail over a
greater area than the Country Hills 2nd Addition. They feel that Connemara Trail
benefits more than just the 2nd Addition and by entering into a payback agreement
they can spread their cost on their books as they seethe benefit received from
Connemara Trail. For instance, they would consider some benefit over the lst and
2nd addition, and future unplatted parcels that they own. We cannot go back and
assess the lst addition, nor would we want to. We could spread the assessments
over some of the unplatted properties that U. S. Homes owns because they were
notified in the original public notice. However, the City and U. S. Homes would
have to enter into an agreement as to how to spread the assessment and also sign
a waiver of hearing because we did not notify any of U. S. Homes unplatted
property for the final assessment hearing. The repayment agreement that U. S.
Homes proposes is much less cumbersome and we hope that they can supply us with
an acceptable Letter of Credit.
As for Council action on this matter, I would recommend that if we receive the
necessary signed agreement and acceptable Letter of Credit that Council close the
Public Hearing and not adopt nor certify any assessments. If we do not receive
an acceptable Letter of Credit then I would recommend Council close the

Public Hearing and adopt the assessment roll as is. (The City can always
respread these assessments over property owned by U. S. Homes, as long as they
sign an agreement as to how they will want the assessment spread and also sign a
waiver of hearing that waives their right to a public hearing for the respreading
of these assessments. We will then have to contact the County regarding any
respreading of assessments.)

RESOLUTION 1988 -
A RESOLUTION ADOPTING ASSESSMENT ROLL.
CONNEMARA TRAIL STREET IMPROVEMENTS
PROJECT NO. 169
WHEREAS, pursuant to notice duly given as required by law, the City Council has
met, heard and passed upon all objections to the proposed assessment for
ConnemaraTrail Street Improvements, Project No. 169, and has amended such
proposed assessment as it deems just.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Rosemount,
Minnesota, as follows:

1. Such proposed assessment, a copy of which is attached hereto and made a part
hereof is hereby accepted and shall constitute the special assessment against
the lands named therein, and each tract of land _therein is hereby found to be
benefited by the proposed improvement.
2. Such assessments shall be as follows:
a. The assessments shall be payable in equal annual installments including
principal and interest extending over a period of Three (3) years, with
interest at the rate of eight and two-tenths (8.2%) percent per annum,
in the amount annually required to pay the principal over such period at
such rate, the first of said installments to be payable with general
taxes for the year 1989, collectible with such taxes during the year
1989.
b. The owner of the property so assessed may at any time prior to the
certification of the assessment to the County Auditor, pay to the City
Treasurer, and thereafter at any time prior to November 15 of any year
pay to the County Auditor, the whole of the principal amount of the
assessment on such property provided that no such prepayment shall be
accepted without payment of all installments due to and including
December 31 of the year of prepayment, and the original principal amount
reduced only by the amounts of principal included in such installments
computed on an annual amortization basis.
3. The Administrator/Clerk shall forthwith transmit a certified duplicate copy
of this assessment roll to the County Auditor to be extended on the tax list
of the County.

TIME AND PLACE GENERAL NATURE
OF IMPROVEMENTS: Notice is hereby
given that the City Council of the City of
Rosemount, Minnesota, will meet in the City
Hall in the City of Rosemount, Minnesota, on
the 19th day of April, at 8:88 p.m., or as soon
thereafter as possible, to consider objections
to the proposed assessments for Connemara
Trail Street Improvements of 1997, City Pro-
ject No. 199, heretofore ordered by the City
Council.
_ASSESSMENT ROLL OPEN TO INSPEC-
TION: The proposed.-assesunenWvli is an
file with the Administrator/Clerk and open
to public inspection.
AREA PROPOSED TO BE ASSESSED:
The area proposed to be assessed consists of
every lot, piece or parcel of land benefited by
said improvements, which has been ordered
madeand is as follows: all that area general-
ly described as the SWI/4 of Section 19,
Township 115, Range 19; except the Le Foret
Addition, the Birchview Terrace Addition,
and the Birchview Terrace 2nd Addition and
the north half of the NWY4 of Section 30,
Township 115, Range 19; except Country
Hills First Addition.
TOTAI, AMOUNT OF PROPOSED: The
total amount proposed to be assessed is
$71,993.34.
WRITTEN OR ORAL OBJECTIONS:
Written or oral objections will be considered
at the hearing.
RIGHT OF APPEAL: An owner of proper-
ty to be assessed may appeal the assessment
to the district court of Dakota County pur-
suant to Minnesota Statutes, Section 429.081
by serving notice of the appeal upon the
Mayor or Clerk of the City within 30 days
after the adoption of the assessment and fil-
ing such notice with the district court within
ten days after service upon the Mayor or
Clerk.
LIMITATION ON APPEAL: No appeal
may be taken as to the amount of any assess-
ment adopted by the City Council unless a
written objection signed by the affected pro-
perty owner is filed with the Clerk prior to
the assessment hearing or presented to the
presiding officer at the hearing. All objec-
tion5'to the assessments not'reCeived 9t the
assessment hearing in the manner prescrib-
ed by Minnesota Statutes, Section 429.091 are
waived, unless the failure to object at the
assessment hearing is due to a reasonable
cause.
DEFERMENT OF ASSESSMENTS:
Under the provisions of Minnesota Statutes,
Sections 435.193 to 435.195, the City may, at
its discretion, defer the payment of assess-
ments for any homestead property owned by
a person 65 years of age or alder for whom it
would be a hardship to make the payments.
However, the City has elected not to
establish any deferment procedure pursuant
to those Sections.
