NEW BUSINESS Initiate Eminent Domain Proceedings for Hawkins Pond Easements In order to insure we complete Hawkins fond this year Staff is requesting that Council initiate eminent domain proceedings (condemnation) . The initiation of condemnation proceedings will set a deadline when the City may begin this project. We have set out our appraisers recommendation for compensation to all property owners. As of this date, Mr. Strese has indicated that he wants an extraordinary amount for his easement, in my opinion. The Hawkins have signed a right -of -entry. The Andersons are still considering our proposals and I have not heard anything from the Allens. By initiating the condemnation proceedings, the City may begin construction on Hawkins Pond project within 90 days of filing the action. If we filed on the first of June then we would be able to begin construction no later than the first of September. We can still negotiate with the property owners throughout these 90 days. We can start earlier because we do have the right -of -entry from Mr. Hawkins, which consists of most of, the project. In recent discussions with Mr. Strese, I am doubtful he will authorize a right -of -entry to proceed with the project. Our City Attorney, Dave Grannis, will be present to answer any questions you may have regarding the condemnation or eminent domain proceedings and procedure. CITY OF ROSEMOUNT RESOLUTION 1988 - A RESOLUTION AUTHORIZING CONDEMNATION OF HAWKINS POND EASEMENTS, CITY PROJECT #176 WHEREAS, the City of Rosemount has determined that it is in the public interest to acquire the property necessary for City Improvement Project No. 176. NOW THEREFORE BE IT RESOLVED, by the Council of the City of Rosemount, Minnesota: The City Attorney is hereby authorized and directed to acquire the property necessary for City Improvement Project No. 176 by eminent domain proceedings unless acquired by negotiation or otherwise before the proceedings_ are complete.
