Receive Petition to Vacate a Portion of Dodd Boulevard
I have received from some property owners along Dodd Boulevard a petition to
vacate a portion of Dodd Boulevard. I an attaching a sketch of the portion that
the petitioners are requesting to vacate.
Some of the Council may recall that the City vacated the northerly 10' of Dodd
Boulevard in 1987. The petitioners attorney contacted me after I spoke with the
petitioner, who indicated 10' would be enough, and the attorney told me that they
would have to vacate the full half right-of-way because of the bituminous
driveway situation. I then requested the petitioners attorney to have a sketch
and legal description for the portion of Dodd Boulevard they wish to vacate and
to suhnit it with anther petition.
I now have that legal description for the vacation of the south part of Dodd
Boulevard which is basically west of the intersection with Delft Avenue. I also
requested the attorney to have the private utilities located that exist within
the old right-of-way. The only private utility that does exist is the telephone
and the petitioners attorney informed me that the telephone company would accept
a private easement from the petitioners to remain at their present location
within Dodd Boulevard.
Because the petitioner has submitted everything I have requested, I would
recommend that Council receive the petition to vacate a portion of the south part
of Dodd Boulevard according to the attached legal description and set a public
hearing to consider such vacation on June 21, 1988.
