Receive Petition to Vacate Portion of Shannon Parkway Excess Right -of -Way
Attached is a petition from Mr. LeRoy Mullikin of Rosemount requesting the
vacation of some excess right-of-way that is immediately west of Shannon Parkway.
This excess right -of -way -originated when the County corrected the north -south
section line that makes up the easterly boundary of Mr. Mullikins" property and
the westerly boundary of Shannon Parkway. This error starts at zero at County
Road 42 and expands to about forty feet a half mile north of 145th Street. If
the correction were implemented it would mean moving this north -south section
line to the west, thereby encroaching upon property located west of this line.
Rather than encumber existing property the City chose to add the survey
correction to the right=of-way that we are accumulating for Shannon Parkway. In
the Mullikin instance the right-of-way for Shannon Parkway is actually 80, plus
the survey correction or about 971. The City really does not need the additional
17 or so feet for any right-of-way purposes. Therefore Staff has no problem with
recommending the acceptance of this petition to consider the vacation of it.
However, there is some question as to who the underlying owners would be should
the City vacate this property. Should the City accept this petition then I will
contact the City attorney to investigate who the underlying owners would be in
order to facilitate turning the 17' back to the adjacent property owners.
The recommended action for Council would be to receive the petition to vacate a
portion of the excess Shannon Parkway right-of-way. What we find out 'about the
underlying ownership will determine the need for a hearing date to consider this
vacation.
