Receive_ Petition for Drainage Improvement for Carrollton Addition
Attached is a petition from several residents of the Carrollton Addition who are
experiencing drainage problems in their rear yards. Attached to the _petition is
a letter from one of the residence and a sketch that Staff prepared for Councils
reference.
These residents are experiencing some rear yard drainage problems at the west end
of the block by 143rd Street and Cimarron. The storm water runs off the
backyards from near Chili. It is apparent the intention was for this storm water
to drain overland and cross over the curb at the corner of 143rd and Cimarron.
However, due to the development of the rear yards the grade falls short by about
8-12" from being able to flow over land to the street.
The petitioners are also requesting the City install and finance 100% of this
project because they feel the engineering was done improperly at the time.
However, Staff feels that the question of whether or not the engineering was done
appropriately or not is not an issue because had the grading been done properly
or had someone anticipated the need for installing a storm sewer pipe to these
backyards this storm sewer would have been paid for by the residents along with
the other public improvements. Therefore I cannot recommend that the City
participate 100% in this situation.
I did speak to Mr. Bergacker about this problem. I offered to assist the 4 or 5
residents affected by this problem by having City crews install a pipe drain to
that area. The residents whose rear yards are affected by the ponding would
be responsible for the paying for the material cost. I told them I felt it would
cost roughly between $1,500-$1,800 for the necessary materials. Dividing that by
the five people I understood to be experiencing the brunt of the problem
would result between $300-$350 apiece.
Of course we could do nothing and let the property owners fill in portions of
their rear yards, at their expense, that are not located within the platted
utility and drainage easements. This will only shift the problem further
upstream.

In summary, we recommend that Council does accept this petition, but because rear
lot drainage problems should not be the responsibility of the City, especially
when there is no public storm sewer system or streets draining into the
backyards. We also recommend that if the Council wishes to assist these people,
we offer to these people the use of City forces to install the pipe and catch
basin necessary to drain this area and have the adjacent homeowners pay for the
materials.

Dear Mr. Hefti,
We would like to inform you of a drainage easement problem
between the houses that face north on 143rd St. and the houses
that face south on Upper 143rd St. The easement which starts
by Chili Avenue and goes westward toward 3658 143rd St. and is
supposed to drain to the street between the houses 3658 and
3676 143rd Street. Due to the lack of slope the water does not
drain.
We feel that the proper way to correct this problem is to install
an underground drain starting at the backyard of 3658 and running
between 3658 and 3676 to connect to the storm sewer on 143rd St. W.
Since the initial engineering was obviously not done properly,
we feel the homeowners should not be assessed for any of the
cost to correct this problem.

This letter is to inform you of our intention to tate passession
of the house and property at :,658 143rd Street West in Rosemount,
[In as of June 15t, 1988. We ar-e looking forward to living in the
corwimunity of Rosemount which is known for its marry fine services
and school system. We do however have a concern about the
drainage situation immediately behind our new house and those of
other houses between Upper 143rd and 143rd streets at the west
end of the Carrolton 1 addition, It appears that there is a
natural drainage or- sur -face flow of water behind all of these
houses frc,m as fare east as Chile avenue. At the present time the
lot of 3658 is riot developed so during rainny wet periods, water
can be observed to be standing over the majority of"the baclyard
of 3658.
Tire neighbors in the area who have lived in the area for at
least 4 years indicate that water drainage has always been a
problem in the area and that with the construction of the house
at 3658 the problem has been more noticeable. We belive that with
the development of the lot (fill and sod) the drainage
situation will become a problem for more residents of the area
since the area is low while the curb on 143rd is high.
We suggest that the city place a the outlet at the backyard
area of 3658 lot or neighboring lots and run a tile line along
the property line between 3658 and 3676 143rd St. West. Tile city
of Rosemount has already made provisions for drainage in the
empty lot ,just to the north of 3GS8.
Any help that you can give us in this matter would be most
appreciated.
