Amendment to Agreement for Highway Design and Construction - CSAR 42
The County is requesting the City to amend the agreement we have with them
regarding the construction of CSAH 42 from U.S. Highway 52 to Trunk Highway 55.
The reason for this amendment is to allow the County to turn back the quarter
mile segment of Emery Avenue that used to be the County State Aid Highway 42
alignment. Once the new County Road 42 alignment is completed and open to
traffic, the old alignment on Emery Avenue will not be required for County
purposes.
We don't have a lot to say about this other than the County must upgrade Emery
Avenue to County standards for gravel roads before they can turn it back to the
City. This is stated in the agreement, however I would recommend that Council
specify that the County construct acceptable ditches along this section of Emery
Avenue and place a second chloride application on it as part of this turnback
agreement. Pending these considerations, I would recommend Council approving
this amendment.

AMENDMENT TO
AGREEMENT FOR HIGHWAY DESIGN AND CONSTRUCTION
THIS AMENDMENT TO AGREEMENT for Highway Design and Construction
of State Project No. 19-642-21, County Project No. 42-10, dated
August 25, 1987, is made and entered into by and between the
County of Dakota, hereinafter referred to as the "County" and the
City of Rosemount, hereinafter referred to as the "City".
The County and City agree that Paragraph No. 11 shall be included
and read as follows:
11. The City agrees that the existing alignment of County
State Aid Highway 42 (Emery Avenue) between 145th Street
and County Road 38 meets county standards for a
comparable road in the County and is acceptable for
turnback to the city upon completion of the construction
of State Project No. 19-642-21, County Project No.
42-10.
IN WITNESS THEREOF, the City of Rosemount and the County of
Dakota have caused this amendment to be executed by their
respective officers.
