PUBLIC HEARING
Vacate Portion of Dodd Boulevard
This public hearing is a result of Council accepting a petition from the property
owners to vacate the southerly 1/2 right of way of Dodd Boulevard, west of Delft
Avenue. At the public hearing Council will hear testimony from any interested
parties regarding this vacation.
This particular part of the Dodd Boulevard roadway was obliterated when the new
County Road 42 was built several years ago. While the roadway was physically
removed from Diamond Path to Delft Avenue, the right of way still remains. What
necessitate this street vacation is that a portion of the,4-plex condominium
located just south of this area encroaches on the right of way. In order to
clear title for these people to plat this as a condominium the City must vacate
the half right of way of Dodd Boulevard so that it will revert to the
petitioners and they can pursue their condominium plat.
Attached to this memo is a copy of the sketch showing a portion of Dodd Boulevard
that the applicant is requesting the City to vacate. There is a buried telephone
line within this portion of the Dodd Boulevard right of way. In speaking with
the applicants attorney I am under the understanding that the applicant will
grant a private easement to the telephone company. The City has no utilities
within this half right of way and therefore has no real interest in keeping this
right of way.
Recommended action for Council to take would be to close the public hearing and
approve the vacation of Dodd Boulevard as described in the attached sketch and to
authorize the subsequent recording of this document with the County.

RESOLUTION 1988 -
A RESOLUTION CAUSING A STREET VACATION
ON A PORTION OF DODD BOULEVARD
WHEREAS, the City Council at its Regular Meeting of June 3, 1988 received a
petition for street vacation described as follows, to -wit:
That part of the Southwest Quarter of Section 30, Township 115, Range 1.9,
Dakota County, Minnesota described as follows: Commencing at a point on tale
south line of said Southwest Quarter distant 636.00 feet east from the
southwest corner of said Southwest Quarter; thence North 0 degrees 06
minutes 21 seconds West, assuming the south line of said Southwest Quarter
bears North 89 degrees 53 minutes 39 seconds East, a distance of 205.24 feet
to the centerline of Dodd Boulevard and the point of beginning of the land
to be described; thence South 62 degrees 39 minutes 53 seconds West along
said centerline a distance of 331.64 feet to the north ;right of way line of
C.S.A.H. No. 42; thence South 80 degrees 51 minutes 21 seconds East along
said north right of way line of C.S.A.H. No. 42 a distance of 55..50 feet; ,
thence North 62 degrees 39 minutes, 53 seconds East along the southerly
right of way line of said Dodd Boulevard a distance of 270.03 feet; thence
Norah 0 degrees 06 minutes 21 seconds West a distance of 37.11 feet to the
point of beginning.
WHEREAS, a public hearing was scheduled and held on the 21st day of May, 1988
after due publication as required by law, and all interested persons were given
an opportunity to be heard; and
WHEREAS, it appears that it will be for the best interest of the City of
Rosemount to vacate said street as it does not serve a public purpose.
NOW THEREFORE BE IT RESOLVED, that the following street is hereby vacated, to
wit.
That part of the Southwest Quarter of Section 30, Township 115, Range 19,
Dakota County, Minnesota described as follows: Commencing at a point on the
south line of said Southwest Quarter distant 636.00 feet east from the
southwest corner of said Southwest Quarter; thence North 0 degrees 06
minutes 21 seconds West, assuming the south line of said Southwest Quarter
bears North 89 degrees 53 minutes 39 seconds East, a distance of 205.24 feet
to the centerline of Dodd Boulevard and the point of beginning of the land
to be described; thence South 62 degrees 39 minutes 53 seconds West along
said centerline a distance of 331.64 feet to the north right of way line of
C.S.A.H. No. 42; thence South 80 degrees 51 minutes 21 seconds East along
said north right of way line of C.S.A.H. No. 42 a distance of 55.50; feet;
thence North 62 degrees 39 minutes, 53 seconds East along the southerly
right of way line of said Dodd Boulevard a distance of 270.03 feet; thence
North 0 degrees 06 minutes 21 seconds West a distance of 37.11 feet to the
point of beginning.

BE IT FURTHER RESOLVED, that the City Clerk shall prepare a notice of completion
of the proceedings which shall contain the name of the City, identification of
the vacation and a statement of the time of completion thereof, and shall present
the same to the County Auditor and then file a copy with the Register of Deeds.
