6.d Authorize Condemnation of Ponding Easement - LeForet
Addition
Staff is requesting that Council authorize condemnation
proceedings to acquire a ponding easement over a portion of Lot
1, Block 1, LeForet Addition. The owner of this parcel, Mr.
Sample, has refused the appraised value of $10,400 for about
33,000 square feet of his 3 acre lot His counter-offer of
having the city install water and sanitary sewer service to his
lot is too costly for water and not feasible at the present time
for sanitary sewer.
This easement is necessary because it is a part of the storm
sewer drainage plan for the Country Hills`lst and 2nd Additions.
The vast majority of the pond is located within the Country Hills
2nd Addition. The drainage system is in place and operating.
Recommended action for Council is to adopt the attached
resolution that authorizing obtaining this necessary ponding j
easement through eminant domain proceedings.

RESOLUTION 198$ -
A RESOLUTION AUTHORIZING CONDEMNATION
OF PROPERTY FOR PONDING PURPOSE
WHEREAS, the City Council of the City of Rosemount has determined
that it is in the public interest to acquire the property
described as follows for storm water ponding purposes.
The southerly 150 feet of the westerly 220 feet of Lot
1, Block 1, LeForet Addition to the City of Rosemount.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City
of Rosemount hereby authorizes and directs the City Attorney to
acquire the property described above by eminent domain
proceedings unless acquired by negotiations or otherwise before
the proceedings are complete.
ADOPTED this 5th day of July, 1988.
