RE: Fire Department/Code Amendments
Attached please find a memo from Scott Aker regarding proposed changes to the
City Code. This change is in response to court decisions and state legislative
changes concerning municipal employees' duties, responsibilities and authority to
perform them.
It is becoming common for city employees, especially public safety personnel, to
be sued for action they took in their positions, acting responsibly, erring in
judgment and being left on their own to defend themselves and liable for
financial payment because there was no stated authority to perform the acts by
the city council.
It is in this lite that this proposed amendment is offered, and I recommend its
approval.
A draft ordinance outlining the amendment will be available Tuesday at the
meeting.
