LeRoy Piullikin, whose property abutts Shannon Parkway at the southwest corner of Shannon Parkway and i45th Street, requesting to vaeate Shannon Farkway excess right-of-way along the west side. This excess right-of-way resulted in the relocation of ttie �ontimer�t marking t}ie northwest corner of the northeast quarter o£ Section 30, which movecl the east line of the southwest quarter also. This shift was towards the west. The result in excess right-of-way came about from the platting of the Ever�reen, Acres Addition located in the southwest corner of Shannon Parkway and 145th Street. This platting occurred after the correctian was made and therefore was platted up to this Iine. The property if vacated would returri to the previc�us owner, Ptr. Bill Jacobson. He is the developer of the Shannon Park Townhomes Addition. In canversations with tir. Jaeobson, he indicated that he would be happy to quick claim deed the excess right-of-way over to the adjacent lots in the Evergreen Acr�es Addition. Although the 'section line alignment discrepancy continues uritil it converges at County Road 42, which is the southwest corner of the southwest quarter, this does not pose the same problems to the Broback Additions as it does to the Evergreen Acres Addition because the Broback Additions were platted up to this line prior to the correction taking place. The subsequent plats �f the Carrollton Additi�n and the proposed Limerick Way Addition are only �latting c�p to t}ie �cctapied lines of the Broback Additions. In other words these properties are not even attempting to claim any overlapping of property that theoretically would exist if they based their description on the new alignment. By doing so these developments would nat be providing any excess right-of-way to Shannon Park�aay. By taking this approach, it saves ttie lep,al expense anci hassle of. tlie Cit�y }�avin�; to vacate excess right-of-way and then see that it gets back to tt�e lot owners. Because the platting will only go to the occupied monuments of the Broback Additions, there will not be any title problems arising because of overlaps when property is sold in the future.
