Council of the City of Rosemount was duly held on Tuesday, September
2fl, 1988, at 7:30 p.m. in the Counci,l Gharnbers of �he City Hall.

Cable Commission meeting, advising t�at the comrnis:�3on d:tscusse�3 with
Pen};ert their concexns regarding the current franchise and the need to
renegotia�e certain parts of the �ranchise. The Cable Commission
recommended an agreement be adopted by the City C�uncil granting a
three month franchise to allow the commissic�n and the cable company
tim� to resolve outstanding issues. The administrator advised the
agreement has �ieen signed by Penkert. See Clerk`s File 1988-27.

Community Development Director Johnson advised the proposed plat
consists of 32 units of_ rental townhomes situatAc� on thxee acras

Johnson advised the site plan complies with zaning ordinanc�
requirements and the petition to rezone is consistent with abutting
devPlop�nent and appropriate Comprehensive GuidA Pl.an dnsignation. See

Councilmember Wippermann commented on his opposition to the garage and
parking design of the Shannon Park Townhouses. t�ippe.r_mar�n fAlt the
current townhomes are designed so when entering the carnplex an "alley
affect" is perceived. Councilmer�tber Wi�permann stated hp was not
• opposed to multiple family housing but felt the first townhome project
di3 not present a good image and did not see any better im�r�ssion with
the Limerick Way project.
Develaper t9illiam Jacobson advised the Limer�.rk ��Tay pro�ect is a step
up in quality from the Shannon P�rk Townhous�s and stated th� parking
and garage design would keep resident park3,ng away fram the street.

Consulting Engineer_ Steve Campbell reviewed the sanitary sewer,
watermain, drainage, st.reets and street lightin�� �.nd the c�st estimates
for each. City Engineer Rich �iefti advised the total es�ima�ed cost ��

residential equivalent.
A resident asked whether the spe�d limit on Shannon Parlcway could be
recluced to 30 MPH. The city engineer advised thQ r.ity has requested
that MnDOT Perfo.rrn a speed study, Y�ut the results havP nQt been
received hy the city,

Several residents in the audience o�aposed to the ass�ssment r�ll based
on their not usiizg Shannan Parkway as their primary raad to the
downtown area. Residents on Cornell Couxt and Gornell Trai1 voiced
their objections to the assessments since the west seginent o£ Cornell
Trail was not constructed to Shannon Parkway.
Developer Steve Broback requested consideration €rom the c3.ty regarding
deferment for assessment against the proposed outlot he would dedicate
to the city subsequent to the final plat being recorded. The deuelop��e
asked that the plat far 0"Leary' s Hills Fourth Addition be xec:orded '
with the county prior to the city certifying the assessments far this
development. City staff advised Mr. Broback that �ss�ssrnents wauld be
adjusted crediting the developer for the dedication of the outl4t.

MOTION by Napper to adopt A RESflLUTION ADOPTING THE ASSESSMENT ROLL

A ten minute recess was called with the meeting continuing at
10:10 p.m.
Council reviewed the Joint Powers Agreement be�weezi ths city and the
county to irn�lement a househQld hazardous waste collAction prograrn on
October 1 , 1988, The collectian site will be laca�ed at the Rasemount
Public Works Fa�ility. S�e Clerk' s File 1988-27.
MOTION by Wippermann ta approve the Joint Powers Agreement between
Dakota County and the city for the hausehold haz�rdotis waste p.rogram.

Gity Engineer Rich Hefti recommended postponement of. the b3.d openinq
for a'Leary' s Hills 4th Addition since the develo�ae� was not abl� t�

MOTION by Walsh to postpone the bid opening until the developer has met
�he terms and conditions of the development contract. SECOND by

City �ngineer Rich Hefti presented the k�ids received on September 1G,
1988, at 11 :00 a.m, for the construction of T�i,ft Station #5. fieft3.
recommended aceeptance of ths bir�s and award the contract ta the lowest
responsible bidder, Orr Constructian, in the amount of $89,20Q.00.
Councilmember Wippermann questioned whether th� sizing c�f the lift
station included the p��rcel known as the "Birger F�rm" an� �roper�y
just north of this area. Hefti advised �he �ari3ina� £�asiha,lity report
proposAd that the lift s�ation cover the "�3irger F�rm" �rea.

MOTION by Walsh to adopt A RESOLUTION RECEIVING BID5 AND AWARDING
CONTRACT ON LIFT STATION #5 (COUNTRY HILLS 3RD ADDITIdN) CITY PROJECT
NO. 192. SECOND by Hoke. Ayes: Napper, Walsh, WippArmann, Hoke.
Nays: 0.
Administrator Stephan Jilk advised he and City Attorney David Grannis
met with Dak.ota County Technical Institute officials to complete the
sal� of the old city hall property. Jilk xeviewed the items that
needed clarification in order to complete the sale and presented an
Addendum to the Purchase Agreement listing thosP items. CounGilmember
Walsh questioned whether an easement was provided for the gas li.ne
which runs adjacent to the property. Superintenc�ent n�n McGuire
assured Council that a future easement would be gr.antAd if necessary.
Superintendent Don McGuire and Business Manager Ray Jpsh presented the
ci�y with a check for the finai balance due on �he sale of the o1r� city
hall. See Clerk's Fi1e 1988-26.
MOTIQN by Napper to approve the Addendum to the Purchase Jlgreement ant3
authorize the necessary signatures to the Addenc�um and the Warra�tty
Deed for the sale of the old city hall to the Dakota County Technical
Institute. SECOND by Hoke. Ayes: Walsh, Wippermann, Hoke, Napper.
Nays: 0.
Administrator Stephan Jilk led discussion regarding the Council' s
directive to tour xesource recovery facili.ties in the immAdia�e are�.
The administrator advised the vendor for the county resource xecovery
fac3lity, Combustian Engineerinc�, does not have a faci.J�i.ty in the
United States similar to the one proposed to be built in Rosemount bu�
a�e willing to sehedule tours of the3.r facilities in G�rmany and Italy.
It was the general aonsensus of the couneil that it would be beneficial
to view facilities similar in size, same urban s�tting, in operation
for a suhstantial amount of time and owned by Combustion Engineering.
Council di.rected staff to advise the caunty of the city' s interest fo:r
such a tour, to de�ermine if eounty o�ficials would be interested 3n
such a tour and to discuss wi�h county s�aff. the financial ohligations
of the city, county and vendor regarding the tour. See Clerk's File
1988-27.
City Administrator Stephan Jilk requested Coun�cil approval far the city
to offer to its employees a b�nefit plan allowed under Section 1 ?.5 of
the Federal Internal Revenue Code whiGh would permit employees to
deduct from the gross wages aosts for health insur�nce, h�alth and
dental care and child care. Jilk advised the initial cost to the ci.ty
for the program would be approximately $950.00 and a ypariy cost of
approximately $810.40. See Clerk's File 1988-26.

employee benefit plan as outlined in the adrninistrator' s memorandum
