FROM: MICNAEL WOZNIAK, C[TY FLANNER DATE: NOVEMBER 9, 1988 SUBJ: NOVEMBER 15, 2988 - REGULAR MEETING REVIEWS PUBLIC HEARING - CRAIG AND JULIE SIEMERS ZONING APPEAL The p�trpose of this �ubtic hearing is recieve comments and evaluate the denial t�y the Planning Commission of a Building Permit Application for an accessory building to ije located on a 10 acre pareel zoned for agricultural use on Akron Avenue. Included with this review is a copy of the application, a site plan, and a certi€icate af svrvey showing the boundaries af the parcel. The proposed buitding is of pole construction and is metal sided with a mefal rc�af �aith a }�oured conerete floor. the dimensions of the proposed building are 4U' x fi0' (2�Q0 sq. ft.). City policy requires Chat any pro�osed accessory building over 3000 sq. ft. in size to . be located in an Agricutture bistrict which is not to be used for agricultur�l pur{�ases must be approved by the Planning Commission b�fare a Building Permit may be issued. The Pla�ning Commission reviewed this petmit a}�ptication at their Qctober i$th meeting and denied the applieation on the basis that the proposed use of the accessary buildin� i's not permiEted in the Agriculture District. The basis for the Planning Commission's deeision is that the Siemexs are proposing tMis accessory buitding to house three trucks (semi-tractor/trailers) which they own and lease to a private company. The Planning Commission has interpreted this use as that of a C�mmercial Trucking Operation which is 'not allowed in the Agriculture District. If the Siemers happened to be truckers and were simpty �lanning tc� store a singie truck which they personally operated then it could be viewed as a horae occupation and allnwed in the Agriculture District. However, the storage of trucks w�hich which are leasca wc�uld mean that drivers would have to come to the �remises to pick u� and dr�p off the trticks and �robabiy would be �arking their persona} vehieles on the �rc�prerty. Also nothing says that if this nse af the property were allowed that it woutd not be expanded ta inclucie a�lditional trucks. Among the issues of eoncern is that Akron Avenue is noE an improved raad and cauld be negatively impact�d by additional truck traf[ic. It is the Pl�nning Commissions belief that this proposed stvrage of trucks should be treated nc� treatec3 no different than other commercial trucking operations such as Walbon Trucking and not be allowed to be conducted out of a pole barn on a parc�el zoned for Agrieulture. It shvuld be noted also that it is the policy of the City not to allow the constructi�n of an aecessory structure on a property prior to the contruction of a principat structure (home). The Siemers have suggested that they do intend to build a home on the }�roperty ' at some point in the future. If an accessory building were tv be approveci the �ppr�c�ai would have to be eontingent u�on a htiilding Uermit having been issued for � princi�,�1 structure.
