As diScussed at the last Regular Meeting, it is appropriate to take action
on the petition to the City for a discretionary EAW on the praposed
elementary schooi on the Muliery site. Because of the �oi�t reso(utions of
the CiEy and ISD 196 Schaol Board, I would recommend adoption of the
attached resolution,

A Resolution Denying the Pe#ition For A
Discretionary Environmentai Assessment Worksheet (EAW)
On the Potential Construction of An Elementary Schooi
tn The City of Rasemount
WHEREAS, the City of Rosemount received notice of a petition for a
�f discretionary EAW from the Minnesota Environmental Quality Board
{MEQB) on October 2S, 1988; and
� WHEREAS, the �etitipn for the EAW was based u on lhe
P potential
construction of an elernentary sehoot by tndependent School District
� 196 an property referred ta as the "MulTery site;" and
� WHEREAS, the Board of Education of Independent School District 196 �
has, by resoiution, selected a site, other than the Mn}lery site, for '
the proposed construetion of an eiementary school. '
NOW THEREFORE BE IT RESOLYEQ, the City Council of the City �C

Rosemouni does hereby consider the petition for a diseretionary EAW
--.. on the Mallery site to be invalid and denies the request for an EAW. �
BE tT FURTHER RESQLVED, City staff is hereby directed to notify
the petitioner, the proposer and the EQB of this action. '
