Lot Division / CombinationINDENTURE y, 08 THIS INDENTURE made this day of April, 19$7 by and among WALBON PARTNERSHIP ("Walbon") and CITY OF ROSEMOUNT, a Minnesota municipal corporation ("City"); WITNESSETH: WHEREAS, Walbon is owner of certain real property located in the City of Rosemount, Dakiota County, Minnesota, identified as Tracts A, B, C and D and described on Exhibit A hereto attached; and WHEREAS, said Tracts A, B, C and D are adjacent to each other whereby the westerly line of Tract A and the easterly line of Tract B consti- tute the same line, the northerly line of Tract B and the north- westerly line of Tract A constitute the southerly line of Tract C, and the northwesterly lines of Tracts B and C constitute the southeasterly line of Tract D; and WHEREAS, there has been constructed a building on Tract A which Walbon intends to use along with Tracts B, C and D as a single integral unit in its business as a freight hauler; NOW, THEREFORE, the parties herein do hereby covenant and declare that said Tracts A, B, C and D be, and the same hereby are, subject to the following restrictions: - 1. That none of the tracts be sold, transferred, encumbered or otherwise alienated separate and apart from any of the other. It is intended hereby that the ownership of the tracts shall be con- sidered to be the ownership of a single integral tract and that the said boundary lines between said lots shall be deemed to be nonexistent. 2. That none of said Tracts A, B, C or D may be subdivided. 3. That the restrictions herein set forth by this Covenant and Declaration shall continue and be in full force and effect for so long as the presently existing building and other improvements shall exist over and across any part of the said common boundary lines between said tracts.
