MINNESOTA 55068 612--423-4411 PUBLIC NOTICE TO WHOM IT MAY CONCERN: NOTICE IS HEREBY GIVEN, that the City Council of the City of Rosemount will conduct a Public Hearing at 8:00 p.m., Tuesday, September 1, 1987, at the Rosemount City Hall, 2875 145th Street West. The purpose of the hearing is to receive public input on a public right-of-way vacation, of Doyle Path as described as follows That part of Doyle Path as dedicated in the plat of Hollenback & Nelson, Inc. First Addition, according to the recorded plat thereof, Dakota County, Minnesota, lying southeasterly of a circle having a radius of 83.00 feet, the center of said circle being the point of intersection of the centerline of Doyle Path and the northeasterly extension of -a line parallel with and distant 83.66 feet (as measured at a right angle) southeasterly of the northwesterly line of Lot 4, Block 2, said addition. Anyone desiring to be heard with reference to this request for street vacation will be heard at this meeting. Datedthis 11th day of August, 1987.' vi5 'Steph Jilk AdmidistratorgClerk City of Rosemount Dakota County, Minnesota_ CITY OF ROSEMOUNT RESOLUTION 1987 - A RESOLUTION CAUSING A PARTIAL STREET VACATION ON DOYLE PATH WHEREAS, the City Council at its Regular Meeting of September 1, 1987 received a petition for street vacation described as follows, to -wit: That part of Doyle Path as dedicated in the plat of Hollenback & Nelson, Inc. First Addition, according to the recorded plat thereof, Dakota County, Minnesota, lying southeasterly of a circle having a radius of 83.00 feet, the center of said circle being the point of intersection of the centerline of Doyle Path and the northeasterly extension of a line parallel with and distant 83.66 feet (measured at a right angle) southeasterly of the northwesterly line of Lot 4, Block 2, said addition. WHEREAS, a public hearing was scheduled and held on the 1st day of September, 1987 after due publication as required by law, and all interested persons were given an opportunity to be heard; and WHEREAS, it appears that it will be for the best interest of the City of Rosemount to vacate said street as it does not serve a public purpose. NOW THEREFORE BE IT RESOLVED, that the following street is hereby vacated, to -wit: That part of Doyle Path as dedicated in the plat of Hollenback & Nelson, Inc. First Addition, according to. the recorded plat thereof, Dakota County, Minnesota, lying southeasterly of a circle having a radius of 83.00 feet, the center of said circle being the point of intersection of the centerline of Doyle Path and the northeasterly extension of a line parallel with and distant 83.66 feet (measured at a right angle) southeasterly of the northwesterly line of Lot 4, Block 2, said addition. BE IT FURTHER RESOLVED, that the City Clerk shall prepare a notice of completion of the proceedings which shall contain the name of the City, identification of the vacation and a statement of the time of completion thereof, and shall present the same to the County Auditor and then file a copy with the Register of Deeds. Knutson, Mayor DATE: AUGUST 27, 1987 TO: MAYOR & CITY COUNCIL c/o CITY ADMINISTRATOR JILK FROM: CITY ENGINEER HEFTI (j RE: ITEMS FOR THE SEPTEMBER 1, 1987 COUNCIL MEETING PUBLIC HEARING Doyle Path Street Vacation Council set the public hearing for 8:00 p. m, on September 1, 1987 after receiving the petition from the property owners at their August 4, 1987 Council meeting. Staff published the vacation notice in the official legal newspaper and mailed out notices to the effected parties and effected utilities. To date, I have received a response from Peoples Natural Gas that they have no problem with the street vacation. As part of the condition of street vacation I am requiring that the additional right-of-way that needs to be dedicated because of the new cul-de-sac be included in an easement and dedicated to the City prior to vacation of the right-of-way. I have not received this easement yet. Also the Staff is requiring that the petitioners pave the unpaved portion of Doyle Path and the newly created cul-de-sac to City Standards. Therefore, I am recommending that Council approve the vacation request for Doyle Path as indicated in the legal description stated in the public notice subject to the completion of the paving of the unpaved portion of Doyle Path and to the receipt of the fully executed easement for the right-of-way necessary resulting from the new cul-de-sac.
