Staff recommends that the Mayer announce that the purpose of the three
assessment hearings is to fulfill legal obligations for publication and notice
and to allow any remaining written objections to be presented. It should
also be noted thatt anyone previously submitting a written objection need
not resubmit an objection during the hearings. Finally, the Mayor should
note that there will be informal hearings after the close of the three
assessment hearings. The purpose of these informal hearings is to allow
any objector to present evidence or witnesses regarding each individual
contestment.
Attached is a copy of the procedure for the informal hearings, as was
identified in the original assessment notices. We propose to vary that
procedure in one fashion -- staff and other City representatives will make
a single "generic" presentation on the assessment policies, procedures and
benefit to property for all projects. Then individuals or their attorneys
may present arguments or ask questions of the City one by one. Not
knowing who or how many objectors there may be, the Mayor could suggest
that the order of appearance be based on seating in the Chamber, i.e. front
row to back, etc.
Staff will also make a brief presentation at the beginning of each continued
hearing. The purpose is to update the Council and audience on the
engineering related issues for each project. We will attempt to address all
questions or complaints raised at the earlier hearings.
Finally, i will give (he Council a list of recommendations on the objections
received on each project. It doesn't look like it will be ready for packet
distribution. This will not be the final list, since we will be hearing from
objectors on the 29th. We do not recommend action on any assessment roll
prior to October G'. And we do not recommend taking action on any of the
informal appeals, Ilia( may be registered on the 29th, until 0clober 6. i
have spoken with or met with most of the objectors. I don't believe there
will be more than 10 property owners that may wish to utilize (he informal
hearing process,
If an assessment is contested or there is an adjourned hearing,
the following procedure will be followed:
1. The city will present its case first by calling witnesses
who may testify by narrative or by examination, and by the
introduction of exhibits. After each witness has testified, the
contesting party will be allowed to ask questions. This procedure
will be repeated with each witness until neither side has further
questions.
2. After the city has presented all its evidence, the
objector may call witnesses or present such testimony as the
objector desires. The same procedure for questioning of the
city's witnesses will be followed with the objector's witnesses.
3. The objector may be represented by counsel.
4. Minnesota rules of evidence will not be strictly applied;
however, they may be considered and argued to the council as to
the weight of items of evidence or testimony presented to the
council,
5. The entire proceedings will be taped -recorded.
6. At the close of presentation of evidence, the objector may
make a final presentation to the council based on the evidence
and the law. No new evidence may be presented at this point.

of a proposed individual assessment at an adjourned meeting upon

advisable.

TO WHOM IT MAY CONCERN:
Notice is hereby given that the council will meet at 8:00 p.m. on
September 29, 1987, at the city hall to pass upon the proposed
assessment for the street improvements of 130th Street between

The amount to be specially assessed against your particular lot,
piece, or parcel of land is attached to this notice. You may at
anytime prior to certification of the assessment to the county
auditor pay the entire assessment on such property, with interest
accrued to the date of payment, to the county auditor. No
interest shall be charged if the entire assessment is paid within
30 days from the adoption of this assessment. You may at any
time thereafter, pay to the county auditor the entire amount of
the assessment remaining unpaid, with.`interest accrued to
December 31 of the year in which such payment is made.
Such payment must be made before November 15 or interest will be ,
charged through December 31 of the succeeding year. If you
decide not to prepay the assessment before the date given above
the rate of interest that will apply is 8.2 percent per year.
