7. Ken Rose Alley Vacatign
We have yet to confirm whether the City owns in fee a 20 feet strip
of land behind the Ken Rose Shopping Center, or whether it is a
public alley. We're proceeding as if it is an alleys In either case the
actions we'll recommend will be the same.
The descriptions for the Ken Rose Center include Lot 47, Lot 48 and
the north 70 feet of Lot 61. The legal descriptions all exclude the
west 20 feet for alley. As part of remodeling and code improvements
to the center, a stairway has been built, as a fire exit, partly into the
alley. Because the City no longer owns the municipal liquor store, we
don't feel there is any particular interest in having a public alley.
The stairway now represents a liability as it extends into the alley.
Staff recommends vacating the alley and/or deeding the property to
the center owners. We will recommend placement of a drainage and
utility easement on the west ten feet of the three parcels. This will
protect existing utilities (gas, electric and phone) and yet eliminate
any public liability for the present encroachment. Access from 145th
Street will not change. Delivery trucks or garbage trucks will be able
to use the post office driveway; however, general public use of the
Ken Rose "alley" will be at the discretion of the owners.

A RESOLUTION FOR THE VACATION OF A PUBLIC ALLEY
WHEREAS, the City of Rosemount has a right-of-way dedicated as a public
alley; and
WHEREAS, the right-of-way is only used for access to the private
property; and
WHEREAS, the City Council of the City of Rosemount wishes to consider
vacating this alley way to the betterment of the citizens of Rosemount.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of
Rosemount hereby causes vacation of the public alley described below
subject to the placement of a drainage and utility easement over and
across the west ten (10) feet'of the same description:
The west 20 feet of Lots 47 and 48, and the west 20 feet of
the north 70 feet of Lot 61, all in Auditor's Subdivision No.
1, Dakota County, Minnesota.
ADOPTED this 6th day of October, 1987.

NOTICE IS HEREBY GIVEN,that the City Council of the City of
Rosemount will conduct a Public Hearing at 8:00 p.m., Tuesday,
October 6, 1987, at the Rosemount City Hall in the Council Chambers
at 2875 145th Street West.
The purpose of this hearing is to receive public input on a public
alley way vacation described as follows:
The west 20 feet of Lots 47 and 48, and the west 20 feet
of the north 70 feet of Lot 61, all in Auditor's Subdivision
No. 1, Dakota County, Minnesota.
Anyone desiring to be heard with reference to this request for street
vacation will be heard at this meeting.
