A partial street vacation hearing was held February 3, 1987, to
consider vacating a portion of 130th right-of-way. The ROW in
question is contiguous with Lot 12, Block 3, .lay .Simon's First
Addition. The western portion of the 33 feet ROW is under water
and the eastern portion is encumbered with a private well and
driveway. In addition to the water issue on the west, there are
some steep slops on the eastern portion.
Norman Brucker, 12865 Bacardi Avenue, is owner of the lot in
question. he has petitioned for the vacation in order to eliminate
existing title problems. Because of the topographic problems for a
street alignment, staff is not opposed to the vacation. Our
recommendation earlier this year was to vacate the east half of the
ROW, subject to receipt of a ponding easement on the west half.
We have received an executed easement from the Bruckers. Staff
recommends the partial ROW vacation as described on the attached
resolution and illustrated on the attached surveys.

RESOLUTION 1987-
A RESOLUTION CAUSING A STREET VACATION
WHEREAS, a public hearing was scheduled and held on the 3rd day of
February, 1987 after due publication as required by law, and all
interested persons were given an opportunity to be heard to consider a
partial street vacation, affecting right-of-way contiguous with Lot 12,
Block 3, Jay Simon's First Addition; and
WHEREAS, it appears that it will be for the best interest of the City of
Rosemount to vacate a portion of said street as it does not serve a
public purpose.
NOW THEREFORE BE IT RESOLVED, that the following street is hereby
vacated, to -wit:
That part of the Jay Simon's First Addition plat recorded and
on file in the Recorder's Office, Dakota County, Minnesota,
described a follows:
The west 240 feet of the east 290 feet of the south 33 feet
(130th Street West) of Jay Simon's First Addition.
BE IT FURTHER RESOLVED, that the City Clerk shall prepare a notice of
completion of the proceedings which shall contain the name of the city,
identification of the vacation and a statement of the time of completion
thereof, and shall present the same to the County Auditor and then file ,
a copy with the County Recorder.
ADOPTED this 3rd day of November, 1987.
