I have received the incident report from the insurance
company on the Helen Lucking claim. The report is not in to
great of detail but it is clear that the adjustor did review
the incident site after our City crews patched the sidewalk.
In reviewing the problem area though and discussing the
incident with Rich Hefti it is my understanding that what
existed prior to the patching was some minor spalling of the
sidewalk in that area. There were no large holes or chunks
of concrete missing which a person could normally trip over
or fall into.
With this understanding I feel that although the claimant
received injuries caused by a fall on the sidewalk that the
sidewalk was not in such disrepair that the City would
consider it such a hazard as to have caused a replacement or
major repair.
I would still recommend that the claim be denied.
