SUBJECT: RON WELVAERT - APPEAL OF PLANNING COMMISSION DECISION
REGARDING CONDITIONS ATTACHED TO APPROVAL OF A BUILDING
PERMIT FOR AN ACCESSORY BUILDING.
SUMMMARY:
Mr. Welvaert wishes to construct a 40' x 52' (2080 sq. ft.) on
his 6.4 acre property at 12086 Biscayne Avenue, which is zoned -
Rural Residence. At its October 20, 1987 meeting the Planning
Commission determined that improved exterior treatment is
necessary for the proposed metal pole building to be consistent
with requirements that have been a condition for approval on
similar requests for oversized structures in residential as well
as agriculture districts. The Planning Commission approved
issuance of a building permit for the proposed structure subject
to addition of a shingled roof and adequate window treatment.
Mr. Welvaert -has deemed these requirements excessive and has
requested an appeal to the City Council.
The construction of large accessory structures for personal
storage on residential properties is becoming an increasing
concern in Rosemount. The impact of large metal buildings on the
visual character of residential areas in very significant. The
Planning Commission has set a precedent of deciding that
accessory buildings larger than 1000 sq. ft. should either be
constructed of materials comparable to the home or well screened
with landscaping; depending on the location both of these
requirements may apply. Included with this memo is a list of
Planning Commission decision regarding accessory buildings 1986-
1987. In each decision in the last couple years some degree of
improved aesthetic treatment was required.
Building Code requirements suggest that any accessory building
over 1000 sq. ft. should be classified for commericial occupancy
with stricter construction standards than would be required for a'
standard pole building. Rather than requiring compliance with
code requirements for commercial occupancy the Planning
Commission has opted to allow construction of accessory buildings
larger than 1000 sq ft provided they are 'constructed of
materials which are comparable to the primary structure (home)
and/or properly screened from neighboring properties.
As shown on the plan (see site plan) the proposed location of the
Mr. Welvaert's Accessory Building is approximately 400' back from
Biscayne Avenue and it will be partially concealed by his home.

However, the building will ,be visible from Biscayne Avenue and
also would be visible from property located to the east,
currently a tree farm, but likely to be developed for residential
at some point in the future.
Based upon conditions required for accessory buildings of similar
size in residential districts and agricultural districts (under
20 acre parcel size) Planning staff would suggest that
requirements being imposed on Mr. Wel,vaert are not excessive.
