7b. Receive Feasibility Report/Order Public Hearing-CSAH 42 (52-55)
I am attaching a copy of the feasibility report for the improvements of CSAH 42
from TH 52 to TH 55. Our Consultants prepared the report at my request to
provide information to Council and a recommendation of the feasibility of this
Project. As you know, we held a Public Hearing last December regarding this
matter. However, the County since has proposed to change the easterly alignment
of County Road 42 past Emery Avenue so that it made less of an impact on a center
pivot irrigation system that would have had to be relocated based upon the
previous alignment. The new alignment leaves the center pivot irrigation system
in tact and also provides paved assess from County Road 38 to County Road 42.
The previous alignment did not allow an intersection with County Road 38, thereby
leaving Emery Avenue as a gravel surface gap between County Road 38 and County
Road 42.
Because of the revised alignment and time lapse since the last Public Hearing I
would recommend that Council order a new Public Hearing to be held at 8:00 p. m.
on December 15, 1987. We can meet all our publications and mail notice deadlines
using this timetable.

matter,

A RESOLUTION RECEIVING THE FEASIBILITY REPORT FOR
IMPROVEMENTS OF CSAH 42, FROM TH 52 TO TH 55 AND

CALLING FOR PUBLIC HEARING TO CONSIDER THE PROJECT
WHEREAS, the City Council deemed it necessary and expedient that the
County of Dakota, Minnesota, construct certain improvements, to -wit:
CSAH 42 from TH 52 to TH 55, in the City as described in accordance with
the feasibility report prepared by Short -Elliott -Hendrickson, Inc.,
consulting engineers; and
WHEREAS, the City Council has been advised by the consulting engineers
that said road improvement project is feasibile and should best be made
as proposed, and the consulting engineers' report to this effect has
heretofore been received by Council, and filed with the City Clerk; and

WHEREAS, the statute provided that no such improvements shall be made
until the Council has held a public hearing on such improvements
following mailed notice and two publications thereof in the official
newspaper stating time and place of the hearing, the general nature of
the improvement, the estimated costs thereof, and the area proposed to
be assessed, in accordance with the law.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of
Rosemount that a public hearing be scheduled to consider the
improvements of CSAH 42 from TH 52 to TH 55, to be held on Tuesday,
December 15, 1987, at 8:00 o'clock p.m. or as soon thereafter as
possible in the Council Chambers of City Hall.
ADOPTED this 1st day of December 1987.
