7a. County Road 38 Turnback Agreement
The County is proposing to turnback County Road 38 (Dodd Road) from 125th Street
(New County Road 38) to Trunk Highway 3. Attached is a copy of the agreement
proposed by the County. I would recommend approving this agreement with the
exception of Item #3 on Page 2. I would recommend that instead of having the
County place gravel on County Road 38 that the County pay us the equivalent cost
of purchasing the gravel and hauling and placing it on County Road 38. We would
then use this money to help fund improving Dodd Road when utilities become
available to this area. I understand that when the hearings were held several
years ago the dollar figure was around $8,000.00. I will verify this with the
County prior to Tuesday nights meeting.
AGREEMENT FOR
REVOCATION OF
COUNTY ROAD
THIS AGREEMENT, made and entered into by and between the
County of Dakota, hereinafter referred to as the "County", and
the City of Rosemount, hereinafter referred to as the "City.
WITNESSETH:
WHEREAS, Minn. Stat. 163.11. Subd. 5, authorizes the
revocation of a County Road by resolution of the County Board;
and
WHEREAS, the County Board intends to pass a resolution
revoking that portion of County Road 38, described below; and
WHEREAS, as a result of said revocation of that portion of
County Road 38 said roadway as described below will revert to
the City; and
WHEREAS, the County and the City desire to define the
responsibilities and obligations which will result from said
revocation;
NOW, THEREFORE, the parties hereto agree as follows:
1. Description of Roadway
The County Board intends to pass a resolution revoking
that portion of County Road 38 described as follows:
County Road 38 between 125th Street and Trunk Highway 3
as shown in Right of Way Map Number 9, as recorded in
Document No. 758603 on file in the Dakota County
Recorder's Office.
2. Effective Date
Revocation of.County Road 38, described in paragraph 1
shall be effective upon resolution of the County Board
except as otherwise provided by law.

3. Condition of Road
The City agrees that when the County places maintenance
gravel on this portion of County Road 38, the roadway
will meet county standards for a comparable road in the
County and will be acceptable for turnback to the City.
4. Future Repairs and Maintenance
Upon the effective date of revocation the City will be
responsible for all maintenance, repair, reconstruction,
traffic control devices including signals and such other
matters concerning County Road 38, which are implied by
ownership.
