RE: City Hall Parking Lot Arbitration
Attached is a copy of the ruling from the Arbitrator on the resolution
for the completion of the west parking lot.
The decision was that the contractor would be liable for the patching of
the low spots on the "ponding" areas to obtain proper drainage and then
seal coat the entire lot.
The dollar value assigned to the work is $3,000. The city's option at
this point is to simply reduce our payment by $3,000 to Arkay
Construction and have the work completed on our own or have them
complete it and pay the entire amount when completed. We will also have
to pay interest from July 7, 1987 on the amount we owed for the parking
lot, less the $3,000; and of course, now the amount of principal for the
lot less the $3,000 is due.
Staff recommends that we pay the amount due on the lot, including
interest from July 7, 1987, retain the $3,000 for the additionai work
and require H.&S. Construction to do the work. We feel we should hold
H.&S, responsible and letting them out with a $3,000 loss on the project
isn't the way to do it.
Also, there are a couple of sections of curbing needed to be raised, by
Arkay, as part of this drainage problem. These then could be done by
Arkay at the time the lot is repaired and seal coated.
Your consideration of this recommendation would include the release of
$14,000 and the retainage of $3,000 to insure the lot is repaired.
