SUBJ: 1988 CDBG Entitlement Application
Attached is a copy of an application to Dakota County for 1988 Community Development
Block Grant funding. As you may recall, Rosemount, Farmington, Lakeville and Hastings
are in "District 4" of the County's entitlement program. Each year two of the four
cities apply for funds for various projects. Last year Farmington and Lakeville split
approximately $192,000. This year Rosemount and Hastings will share a maximum of
$192,000. Because of recent budget cuts, toe amount of 1988 funds may only be
$175,000.
Projects in the CDBG program must be utilized in one of three categories: benefit to
low and moderate income; aid in the prevention of slums and blight; and alleviation of
an urgent community development need. We have utilized past funding to benefit low
and moderate income persons and to eliminate slums and blight. Funds for urgent
community development needs are often difficult to qualify for and are commonly used
for special studies, i.e. planning or engineering feasibilities that benefit low and
moderate income persons.
All of our previous funds have been directed toward projects in and around the
downtown area. We don't have any outstanding ideas for a low and moderate income
project at this time. We are a bit apprehensive about another acquisition and clearance
(slums and blight category) project in the downtown, because we have some vacant
properties with pending developments.
The application before you represents an acquisition and clearance project but not in
the downtown. The Council is aware of the status of Phil's Body Shop. Since 1972,
this site has been a legal non -conforming use. Phil Anderson recently applied for a
permit to construct another commercial building on the 2.5 acre parcel. The property is
zoned Agriculture, which does not permit commercial uses. The Planning Commission
denied the request. The City Council heard an appeal of this action, but did not act
formally on the appeal. The Council directed staff to look at options that may be
amenable to the owner and the City.
Staff, legal counsel and the Planning Commission have concluded that no alteration or
expansion of the commercial use of the property can be allowed without rezoning. The
problem of non-conformance can not be corrected by rezoning, however, because the
owner also wishes to retain his single family home. We would also have problems with
setback requirements, parking and lot coverage. We also question the wisdom of
investments in new structures, given the age, condition and value of the older
structures.

An alternative to this impasse is consideration of financial assistance to acquire and
clear the commercial structures. The property would solely be used as residential,
which is consistent with the Zoning Ordinance. Clearance would also eliminate the
increasing blighting influence the property has on the existing neighborhood and its
impact upon the quality of development in the future. This particular area is in our
next major sewer district. The rolling, ponded and wooded characteristics of the
adjacent properties create the opportunity for one of the more premium quality
residential neighborhoods to develop. The continuation of the body shop and salvage
business inhibits this opportunity; whereas, the clearance enhances it.
I have been working with Jerry Anderson on this issue. He recognizes that the legal
limitations on expansion jeopardize both business opportunities and the condition and
value of the existing commercial buildings. The combination of acquisition funds and
planned expansion funds, as well as future residential value of the existing property,
appears to be adequate for the successful relocation of the body shop and salvage
businesses.
We have preliminary approvals from the County and HUD for the eligibility of the use
of funds. We feel this is a creative and amicable solution to the situation. It provides
for business expansion and improves community development opportunities in the near
future. The City HRA extended its approval for the application at its December 1, 1987
Regular Meeting.
We recommend approval of the attached resolution, which authorizes submission of the
application for 1988 CDBG Entitlement funds to Dakota County.

FY 88 Entitlement Application
Dakota County, Minnesota
Background Information
The City of Rosemount is proposing to utilize FY 88 Entitlement Funds
to acquire and clear blighted buildings. The property in question is a
2.5 -acre parcel, zoned agricultural. The property has been improved
over the years with a single family residence, a house trailer and four
commercial structures. The property was originally owned by a natural
gas company and used as a storage facility. A pumping station is still
owned by the gas company in the southeast corner of the site.
The present owner has occupied the premises since the early 1960s.
This area was under the jurisdiction of the Township of Rosemount. In
1971 the township merged with the Village of Rosemount. A 1972
Comprehensive Guide Plan and Zoning Ordinance of the new village
established the property as agricultural. The use of the property as a
body shop became and remains a legal non -conforming use. The
"grandfather" status allows continuation of the non -conforming
commercial use, but does not permit improvements to the use that would
perpetuate its existence.
Auto salvage has also been an historical incidental use, accessory to the
body shop business. The age of buildings and general appearance of the
site has created a blighting influence in the existing neighborhood. This
particular neighborhood lies within the next phase of planned urban
growth in the city. This area is planned exclusively for residential
development. Public utilities can be made available to the area within
five years. The continuing deterioration of the site compounds the
blighting impact upon existing and developing neighborhoods.
The City of Rosemount proposes to utilize its entitlement funds for the
acquisition and clearance of the blighted non -conforming structures.
The City does not propose to acquire any land or the single family
residence. After clearing the non -conforming structures, the existing
owner will, remain owner of the dwelling and land, which is a Permitted
use under existing and proposed zoning.
