Bechtold - Director of Parks & Recreation DATE: December 9, 1987 SUBJECT: Change in Park Dedication Ordinance With a positive attitude and with foresight the City Council on October 19, 1972 adopted Subdivision Ordinance XVII.4 relating to park dedication. In an effort to maintain open space areas and parks for the growing community they proposed and passed a resolution to have land and/or cash dedicated to the city from each residential development. The importance of developing and maintaining a viable park system was stressed. The dedication ordinance has not been changed from the time it was adopted although there have been many changes in the land value of the community. Since the land value figure is a major part of the dedication formula it should be adjusted to more closely reflect the values of the present time. The change from the present figure that is used of $4,000.00 is requested to be changed to that of $8,000.00. That has been the amount also used in recent purchases of easements by the city. Dedication funds, (land and cash), have been used in conjunction with general funds and fees to develop the park system that we presently have. This relationship of funds is a positive approach to funding sources. Attached are pages of information showing comparisons of the dedication formula with other cities of the area, comparisons of the present formula to that of the proposed formula, and comparisons of the amounts of dedications to be received using the present formula and the proposed formula. The subject of park dedications has been discussed by the Parks & Recreation Committee over the past years on several occasions. At the October 19, 1987 meeting a motion to increase the land value of the dedication formula from the present amount to that of $8,000.00 was passed by the Committee. The formula should then be used for single family developments as well as multiple dwelling developments. The following meeting, November 16, 1987, the Committee passed a motion to have an industrial and commercial dedication added to the city ordinance. That formula is proposed according to that motion at 5% of total land value of the development. Other support for the changes has come from the department heads as well as the Planning Commission. Not all dedications relate specifically to parks.. Industrial and commercial dedications could be designated for use in development of trails, walkways, rest areas, etc.. City staff are available to respond to any questions that you might have relating to this item. XVI1.83 AN ORDINANCE AMENDING ORDINANCE NO. XVIIA - SUBDIVISION ORDINANCE The City Council of the City of Rosemount, Minnesota ordains as follows: SECTION I. Ordinance No. XVIIA, adopted October 19, 1972, entitled "SUBDIVISION ORDINANCE, VILLAGE OF ROSEMOUNT, DAKOTA COUNTY, MINNESOTA," is hereby amended such that subsections b and d of Subdivision 5.7 shall read as follows: b. Dedication. In all new residential subdivisions, the City shall require that a sufficient portion of such land be set aside and dedicated to the public for parks, playgrounds or other public use exclusive of property dedicated for streets and other public ways. It shall be presumed that a sufficient amount of land has been dedicated for parks and playgrounds for the present and future residents of the subdivision if the subdivider dedicates at least four percent (401p) of the land in the subdivision for each dwelling unit proposed to be subdivided (0.04 x number of units). The City upon consideration of the particular type of development proposed in the subdivision may require larger or lesser amounts of land to be dedicated if City the determines that the present and future residents of the subdivision would require greater or lesser amounts of land for such purposes. The City shall determine whether a cash in lieu of land dedication is appropriate. The value of the cash dedication is determined by multiplying the number of acres dedicated by a value of land set by resolution of the City Council, In all new commercial and industrial subdivisions, it shall be presumed that a sufficient amount of land has been dedicated to serve the needs of the resident and working population if the subdivider dedicates at least five percent (5010) of the land in the subdivision for parks, recreation and usable open space. The City upon consideration of the particular type of development proposed in the subdivision may require larger or lesser amounts of land to be dedicated if it determines that the present and future residents of the subdivision would require greater or lesser amounts of land for such purposes. The City shall determine whether a cash in lieu of land dedication is appropriate. The value of cash dedication is determined by multiplying the number of acres dedicated by a value of land set by resolution of the City Council, In all developments, where a subdivision of land has not occurred, or where a dedication has not been made in the past, a contribution shall be made at the time of building permit issuance, according to a formula established by resolution of the City Council. , d. Pedestrian Ways and Trails. The City shall define a meaningful pedestrian circulation system for each development, which connects to the major trail system, parks, schools and shopping areas. Subdividers shall be required to install such sidewalks and trails as determined by the City and according to City standards. Pedestrian improvements required by the City are in addition to the land dedication in subsection b. u SECTION II. This Ordinance shall be in full force and effect from and after its publication according to law. Enacted and ordained into an Ordinance this 15th day of December, 1987. Leland S.
